0011|     RELATING TO CHILDREN; EXPANDING THE DEFINITION OF A FAMILY IN
    |
0012|     NEED OF SERVICES; AMENDING A SECTION OF THE CHILDREN'S CODE.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 32A-3A-2 NMSA 1978 (being Laws 1993,
    |
0016|     Chapter 77, Section 64) is amended to read:
    |
0017|          "32A-3A-2.  DEFINITIONS.--As used in the Family in Need of
    |
0018|     Services Act:
    |
0019|               A.  "family in need of services" means:

    |
0020|                    (1)  a family whose child, subject to
    |
0021|     compulsory school attendance, is absent from school without
    |
0022|     authorized excuse more than ten days during a school semester;
    |
0023|                    (2)  a family whose child is absent from the
    |
0024|     child's place of residence for twenty-four hours or more
    |
0025|     without the consent of the parent, guardian or custodian;
    |
0001|                    (3)  a family in which the parent, guardian or
    |
0002|     custodian of a child refuses to permit the child to live with
    |
0003|     the parent, guardian or custodian; <s>[or]</s>
    |
0004|                    (4)  a family in which the child refuses to
    |
0005|     live with his parent, guardian or custodian; <u>or</u>
    |
0006|                    <u>(5)  a family with a child who has been
</u>    |
<u></u>0007| <u>    emotionally, physically or sexually abused or neglected</u>; 
    |
0008|               B.  "family needs assessment" means an evaluation of
    |
0009|     a child and family for the purpose of identifying the family's
    |
0010|     specific strengths as well as the problems and needs of the
    |
0011|     child and family;
    |
0012|               C.  "family services" means services that address
    |
0013|     specific needs of the family and include:
    |
0014|                    (1)  family preservation services; 
    |
0015|                    (2)  child care services; 
    |
0016|                    (3)  homemaker services; 
    |
0017|                    (4)  crisis counseling; 
    |
0018|                    (5)  transportation services; 
    |
0019|                    (6)  community mental health services; 
    |
0020|                    (7)  individual, family or group counseling
    |
0021|     services;
    |
0022|                    (8)  parent training services;
    |
0023|                    (9)  recreational services; and
    |
0024|                    (10)  community-based services; <u>and</u>
    |
0025|               D.  "plan for family services" or "plan" means an
    |
0001|     intervention plan based on the needs of the child and family
    |
0002|     that incorporates the family's strengths and is developed as
    |
0003|     part of the assessment and referral process."
