0011| RELATING TO CRIMINAL LAW; AMENDING A SECTION OF THE NMSA 1978

0012| TO EXPAND THE DEFINITION OF THE CRIME OF SHOOTING AT OR FROM A

0013| MOTOR VEHICLE.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 30-3-8 NMSA 1978 (being Laws 1987,
|
0017| Chapter 213, Section 1, as amended) is amended to read:
|
0018| "30-3-8. SHOOTING AT DWELLING OR OCCUPIED BUILDING--
|
0019| SHOOTING AT OR FROM A MOTOR VEHICLE.--
|
0020| A. Shooting at a dwelling or occupied building
|
0021| consists of willfully discharging a firearm at a dwelling or
|
0022| occupied building. Whoever commits shooting at a dwelling or
|
0023| occupied building that does not result in great bodily harm to
|
0024| another person is guilty of a fourth degree felony. Whoever
|
0025| commits shooting at a dwelling or occupied building that
|
0001| results in injury to another person is guilty of a third degree
|
0002| felony. Whoever commits shooting at a dwelling or occupied
|
0003| building that results in great bodily harm to another person is
|
0004| guilty of a second degree felony.
|
0005| B. Shooting at or from a motor vehicle consists of
|
0006| willfully discharging a firearm at or from a motor vehicle
|
0007| [with reckless disregard for the person of another].
|
0008| C. Whoever commits shooting at or from a motor
|
0009| vehicle that does not result in injury or great bodily harm
|
0010| to another person is guilty of a fourth degree felony.
|
0011| D. Whoever commits shooting at or from a motor
|
0012| vehicle, with reckless disregard for the person of another,
|
0013| that results in injury to another person is guilty of a third
|
0014| degree felony.
|
0015| E. Whoever commits shooting at or from a motor
|
0016| vehicle, with reckless disregard for the person of another,
|
0017| that results in great bodily harm to another person is guilty
|
0018| of a second degree felony.
|
0019| [C.] F. This section shall not apply to a law
|
0020| enforcement officer discharging a firearm in the lawful
|
0021| performance of his duties."
