0011| RELATING TO WATER; ENACTING A NEW SECTION OF THE NMSA 1978 TO
|
0012| PROVIDE AUTHORITY TO THE STATE ENGINEER TO ISSUE COMPLIANCE
|
0013| ORDERS AND OTHER ENFORCEMENT POWERS; PROVIDING A PENALTY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. STATE ENGINEER--ENFORCEMENT--COMPLIANCE
|
0017| ORDERS--PENALTY.--
|
0018| A. Whenever the state engineer determines that any
|
0019| person has violated any requirement or prohibition pursuant to
|
0020| Chapter 72 NMSA 1978 or Chapter 73, Article 1, 2, 9, 12 or 13
|
0021| NMSA 1978, any regulation adopted by the state engineer
|
0022| pursuant to those laws, or any condition of a permit or license
|
0023| issued by the state engineer pursuant to those laws, or any
|
0024| order entered by a court adjudicating a water right, the state
|
0025| engineer may:
|
0001| (1) issue a compliance order stating with
|
0002| reasonable specificity the nature of the violation and
|
0003| requiring compliance immediately or within a specified time
|
0004| period or assessing a civil penalty for any past or current
|
0005| violation, or both; or
|
0006| (2) commence a civil action in district court
|
0007| for appropriate relief, including a temporary or permanent
|
0008| injunction.
|
0009| B. A compliance order issued pursuant to this
|
0010| section may include a suspension or revocation of any permit or
|
0011| license, or portion of a permit or license issued by the state
|
0012| engineer. Any penalty assessed in the order shall not exceed
|
0013| fifteen thousand dollars ($15,000) per day of noncompliance for
|
0014| each violation and, if assessed for overdiversion or illegal
|
0015| diversion of water, may require repayment of water in an amount
|
0016| double the amount of the overdiversion or illegal diversion and
|
0017| installation of a measuring device approved by the state
|
0018| engineer prior to any future diversion of water. In
|
0019| determining the amount of any penalty to be assessed pursuant
|
0020| to this subsection, the state engineer shall take into account
|
0021| the seriousness of the violation, any good-faith efforts to
|
0022| comply with the applicable requirements and other relevant
|
0023| factors. The state engineer may adopt regulations establishing
|
0024| rates at which monetary penalties will be assessed for varying
|
0025| amounts of overdiversions and illegal diversions.
|
0001| C. A compliance order issued pursuant to this
|
0002| section shall become final unless the person named in the order
|
0003| submits a written request, no later than thirty days after the
|
0004| order is mailed by certified mail, return receipt requested,
|
0005| for a public hearing pursuant to Section 72-2-16 NMSA 1978. If
|
0006| a person submits a request for a public hearing, the
|
0007| enforcement of the compliance order shall be suspended pending
|
0008| the issuance of the final order after the hearing. The hearing
|
0009| shall be conducted pursuant to Sections 72-2-16 and 72-2-17
|
0010| NMSA 1978.
|
0011| D. Penalties collected pursuant to a compliance
|
0012| order shall be deposited in the New Mexico irrigation works
|
0013| construction fund.
