0011| RELATING TO GAME AND FISH; INCREASING CRIMINAL AND CIVIL
|
0012| PENALTIES FOR VIOLATION OF GAME AND FISH LAWS AND REGULATIONS;
|
0013| AMENDING SECTIONS OF THE NMSA 1978.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 17-2-10 NMSA 1978 (being Laws 1931,
|
0017| Chapter 117, Section 7, as amended) is amended to read:
|
0018| "17-2-10. VIOLATION OF GAME AND FISH LAWS OR REGULATIONS-
|
0019| -PENALTIES.--
|
0020| A. Any person violating any of the provisions of
|
0021| Chapter 17 NMSA 1978 or any regulations adopted by the state
|
0022| game commission [which] that relate to the time, extent,
|
0023| means or manner that game animals, birds or fish may be hunted,
|
0024| taken, captured, killed, possessed, sold, purchased or shipped
|
0025| is guilty of a misdemeanor and upon conviction may be sentenced
|
0001| to imprisonment in the county jail for a term not to exceed six
|
0002| months [and]. In addition, the person shall be sentenced
|
0003| to the payment of a fine in accordance with the following
|
0004| schedule:
|
0005| (1) for illegally taking, attempting to
|
0006| take, killing, capturing or possessing of each deer, antelope,
|
0007| javelina, bear or cougar during a closed season, a fine of four
|
0008| hundred dollars ($400);
|
0009| (2) for illegally taking, attempting to
|
0010| take, killing, capturing or possessing of each elk, bighorn
|
0011| sheep, oryx, ibex or Barbary sheep, a fine of one thousand
|
0012| dollars ($1,000);
|
0013| (3) for hunting big game without a proper
|
0014| and valid license, lawfully procured, a fine of one hundred
|
0015| dollars ($100);
|
0016| (4) for exceeding the bag limit of any big
|
0017| game species, a fine of four hundred dollars ($400);
|
0018| (5) for attempting to exceed the bag limit
|
0019| of any big game species by the hunting of any big game animal
|
0020| after having tagged a similar big game species, a fine of two
|
0021| hundred dollars ($200);
|
0022| (6) for signing a false statement to procure
|
0023| a resident hunting or fishing license when the applicant is
|
0024| residing in another state at the time of application for a
|
0025| license, a fine of four hundred dollars ($400);
|
0001| (7) for using a hunting or fishing license
|
0002| issued to another person, a fine of one hundred dollars ($100);
|
0003| (8) for a violation of Section 17-2-31 NMSA
|
0004| 1978, a fine of three hundred dollars ($300); and
|
0005| (9) [to sell, offer] for selling, offering
|
0006| for sale, [offer] offering to purchase or [purchase]
|
0007| purchasing any big game animal, unless otherwise provided by
|
0008| Chapter 17 NMSA 1978, a fine of one thousand dollars ($1,000).
|
0009| B. Notwithstanding the provisions of Section
|
0010| 31-18-13 NMSA 1978, a person convicted a second time for
|
0011| violating any of the provisions of Chapter 17 NMSA 1978 or any
|
0012| regulations adopted by the state game commission that relate to
|
0013| the time, extent, means or manner that game animals, birds or
|
0014| fish may be hunted, taken, captured, killed, possessed, sold,
|
0015| purchased or shipped is guilty of a misdemeanor and upon
|
0016| conviction shall be sentenced to imprisonment in the county
|
0017| jail for a term of not less than thirty days, which shall not
|
0018| be suspended or deferred, and not more than six months. In
|
0019| addition, the person shall be sentenced to the payment of a
|
0020| fine in accordance with the following schedule:
|
0021| (1) for illegally taking, attempting to take,
|
0022| killing, capturing or possessing of each deer, antelope,
|
0023| javelina, bear or cougar during a closed season, a fine of
|
0024| eight hundred dollars ($800);
|
0025| (2) for illegally taking, attempting to take,
|
0001| killing, capturing or possessing of each elk, bighorn sheep,
|
0002| oryx, ibex or Barbary sheep, a fine of two thousand dollars
|
0003| ($2,000);
|
0004| (3) for hunting big game without a proper and
|
0005| valid license, lawfully procured, a fine of seven hundred fifty
|
0006| dollars ($750);
|
0007| (4) for exceeding the bag limit of any big
|
0008| game species, a fine of eight hundred dollars ($800);
|
0009| (5) for attempting to exceed the bag limit of
|
0010| any big game species by the hunting of any big game animal
|
0011| after having tagged a similar big game species, a fine of seven
|
0012| hundred fifty dollars ($750);
|
0013| (6) for signing a false statement to procure a
|
0014| resident hunting or fishing license when the applicant is
|
0015| residing in another state at the time of application for a
|
0016| license, a fine of eight hundred dollars ($800);
|
0017| (7) for using a hunting or fishing license
|
0018| issued to another person, a fine of seven hundred fifty dollars
|
0019| ($750);
|
0020| (8) for a violation of Section 17-2-31 NMSA
|
0021| 1978, a fine of seven hundred fifty dollars ($750); and
|
0022| (9) for selling, offering for sale, offering
|
0023| to purchase or purchasing any big game animal, unless otherwise
|
0024| provided by Chapter 17 NMSA 1978, a fine of two thousand
|
0025| dollars ($2,000).

0007| possessed, sold, purchased or shipped is guilty of a
|
0008| misdemeanor and upon conviction shall be sentenced to

0010| ninety days, which shall not be suspended or deferred, and not
|
0011| more than three hundred sixty-four days. In addition, the
|
0012| person shall be sentenced to the payment of a fine in
|
0013| accordance with the following schedule:
|

|
0015| killing, capturing or possessing of each deer, antelope,
|
0016| javelina, bear or cougar during a closed season, a fine of one
|
0017| thousand two hundred dollars ($1,200);
|
0018| (2) for illegally taking, attempting to take,
|
0019| killing, capturing or possessing of each elk, bighorn sheep,
|
0020| oryx, ibex or Barbary sheep, a fine of three thousand dollars
|
0021| ($3,000);
|
0022| (3) for hunting big game without a proper and
|
0023| valid license, lawfully procured, a fine of one thousand
|
0024| dollars ($1,000);
|
0025| (4) for exceeding the bag limit of any big

0001| game species, a fine of one thousand two hundred dollars

0017| to purchase or purchasing any big game animal, unless otherwise
|
0018| provided by Chapter 17 NMSA 1978, a fine of three thousand
|
0019| dollars ($3,000).
|
0020| [B.] D. Any person who is convicted of a
|
0021| violation of any regulations adopted by the state game
|
0022| commission [which] that relate to the time, extent, means
|
0023| or manner that game animals, birds or fish may be hunted,
|
0024| taken, captured, killed, possessed, sold, purchased or shipped,
|
0025| or of a violation of any of the provisions of Chapter 17 NMSA
|
0001| 1978, for which a punishment is not set forth under
|
0002| [Subsection A of] this section, shall be fined not less than
|
0003| fifty dollars ($50.00) [nor] or more than five hundred
|
0004| dollars ($500) or imprisoned not more than six months or both."
|
0005| Section 2. Section 17-2-26 NMSA 1978 (being Laws 1912,
|
0006| Chapter 85, Section 45, as amended) is amended to read:
|
0007| "17-2-26. CIVIL LIABILITY.--
|
0008| A. The director of the department of game and fish,
|
0009| or any other officer charged with enforcement of the laws
|
0010| relating to game and fish if so directed by the director, may
|
0011| bring a civil action in the name of the state against any
|
0012| person unlawfully wounding or killing, or unlawfully in
|
0013| possession of, any game quadruped, bird or fish, or part
|
0014| thereof, and recover judgment for the following minimum sums as
|
0015| damage for the taking, killing or injuring:
|
0016| for each elk--------------------------- [$200.00]
|

|
0018| for each deer-------------------------- [50.00]
|

|

0005| C. The pendency or determination of an action for
|
0006| damages or payment of a judgment, or the pendency or
|
0007| determination of a criminal prosecution for the same taking,
|
0008| wounding, killing or possession, is not a bar to the other, nor
|
0009| does either affect the right of seizure under any other
|
0010| provision of the laws relating to game and fish."
|
0011| Section 3. EFFECTIVE DATE.--The effective date of the
|
0012| provisions of this act is July 1, 1997.

0015| is enacted to read:
|

|
0017| "[NEW MATERIAL] LANDOWNER TAKING--CONDITIONS--DEPARTMENT
|
0018| RESPONSIBILITIES.--
|
0019|
|
0020| A. A landowner or lessee, or employee of either, may
|
0021| take or kill an animal on private land, in which they have an
|
0022| ownership or leasehold interest, including game animals and other
|
0023| quadrupeds, game birds and fowl, that presents an immediate
|
0024| threat to human life or an immediate threat of damage to
|
0025| property, including crops; provided, however, that the taking or
|
0001| killing is reported to the department of game and fish within
|
0002| twenty-four hours and before the removal of the carcass of the
|
0003| animal killed, in accordance with regulations adopted by the
|
0004| commission.
|
0005|
|
0006| B. A landowner or lessee, or employee of either, may
|
0007| take or kill animals on private land, in which they have an
|
0008| ownership or leasehold interest, including game animals and other
|
0009| quadrupeds, game birds and fowl, that present a threat to human
|
0010| life or damage to property, including crops, according to
|
0011| regulations adopted by the commission. The regulations shall:
|
0012|
|
0013| (1) provide a method for filing a complaint to the
|
0014| department by the landowner or lessee, or employee of either of
|
0015| them, of the existence of a depredation problem;
|
0016|
|
0017| (2) provide for various departmental
|
0018| interventions, depending upon the type of animal and depredation;
|
0019|
|
0020| (3) require the department to offer at least three
|
0021| different interventions, if practical;
|
0022|
|
0023| (4) require the department to respond to the
|
0024| initial and any subsequent complaints within ten days with an
|
0025| intervention response to the complaint, and to carry out the
|
0001| intervention, if agreed upon between the department and the
|
0002| landowner, within five days of that agreement;
|
0003|
|
0004| (5) permit the landowner or lessee to reject for
|
0005| good cause the interventions offered by the department;
|
0006|
|
0007| (6) require a landowner or lessee to demonstrate
|
0008| that the property depredation is greater in value than the value
|
0009| of any wildlife-related income or fee collected by the landowner
|
0010| or lessee for permission to take or kill an animal of the same
|
0011| species, on the private property or portion of the private
|
0012| property identified in the complaint as the location where the
|
0013| depredation occurred; and
|
0014|
|
0015| (7) permit the landowner, lessee or employee, when
|
0016| interventions by the department have not been successful and
|
0017| after one year from the date of the filing of the initial
|
0018| complaint, to kill or take an animal believed responsible for
|
0019| property depredation.
|

|
0021| C. For purposes of this section:
|
0022|
|
0023| (1) "commission" means the state game commission;
|
0024|
|
0025| (2) "department" means the department of game and
|
0001| fish; and
|
0002|
|
0003| (3) "intervention" means a solution proposed by
|
0004| the department to eliminate the depredation."".

|
0006| 7. Renumber the succeeding section accordingly and adjust

0007| all cross-references to correspond with these amendments.
