0011| RELATING TO THE ENVIRONMENT; ENACTING A NEW SECTION OF THE NMSA

0012| 1978 TO PROHIBIT THE STATE AND ITS POLITICAL SUBDIVISIONS FROM

0013| ENDORSING COMMERCIAL HOUSEHOLD CONSUMER PRODUCTS.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. CONSUMER PRODUCT INFORMATION--IMPROPER
|
0017| INTERFERENCE IN BUSINESS COMPETITION BY STATE GOVERNMENT.--
|
0018| A. No state agency, county or political subdivision
|
0019| shall endorse the viability of a particular household consumer
|
0020| product or promote the use of one commercial product over
|
0021| another. No state agency, county or political subdivision
|
0022| shall provide information on household hazardous substances
|
0023| unless the information is competent and reliable.
|
0024| B. As used in this section, "competent and
|
0025| reliable" means information based on scientific study that
|
0001| includes tests performed by a certified laboratory and verified
|
0002| by scientific peer review.
