0011| RELATING TO EDUCATION; ENACTING THE WORK FORCE EDUCATION ACT;

0012| MAKING AN APPROPRIATION.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. A new section of the Public School Code is
|
0016| enacted to read:
|
0017| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0018| the "Work Force Education Act"."
|
0019| Section 2. A new section of the Public School Code is
|
0020| enacted to read:
|
0021| "[NEW MATERIAL] PURPOSE OF ACT.--The purpose of the
|
0022| Work Force Education Act is to:
|
0023| A. facilitate the establishment of a statewide
|
0024| school-to-work system involving partnerships among public
|
0025| schools, public post-secondary educational institutions, and
|
0001| the business and education communities to address the education
|
0002| requirements of New Mexico's current and future work force;
|
0003| B. provide for the development of the academic and
|
0004| technical competencies that students must demonstrate in
|
0005| today's workplace through work-based and school-based learning
|
0006| opportunities; and
|
0007| C. establish procedures to assist students in
|
0008| transition into the workplace, a job training program or a
|
0009| post-secondary educational institution."
|
0010| Section 3. A new section of the Public School Code is
|
0011| enacted to read:
|
0012| "[NEW MATERIAL] DEFINITIONS.--As used in the Work Force
|
0013| Education Act:
|
0014| A. "council" means the work force education
|
0015| coordinating council; and
|
0016| B. "division" means the vocational education
|
0017| division of the department of education."
|
0018| Section 4. A new section of the Public School Code is
|
0019| enacted to read:
|
0020| "[NEW MATERIAL] DEPARTMENT DUTIES.--The department
|
0021| of education shall:
|
0022| A. implement the provisions of the Work Force
|
0023| Education Act; and
|
0024| B. cooperate with the executive, the labor
|
0025| department, public school districts, public post-secondary
|
0001| educational institutions and communities to establish and
|
0002| maintain a school-to-work system to include:
|
0003| (1) a work-based component involving
|
0004| collaborative partnerships between schools and employers that
|
0005| offers students practical work and learning experiences within
|
0006| the workplace;
|
0007| (2) a school-based component that provides
|
0008| students with opportunities for career exploration, instruction
|
0009| in both academic and technical skills and guidance in
|
0010| identifying career options and setting educational goals; and
|
0011| (3) connecting activities that ensure
|
0012| coordination between work-based and school-based learning
|
0013| components that:
|
0014| (a) match students with employers and
|
0015| establish relationships between education and work;
|
0016| (b) provide technical assistance to
|
0017| schools, students and employers;
|
0018| (c) promote employee participation;
|
0019| (d) provide job placement, continuing
|
0020| education or further training assistance;
|
0021| (e) establish linkages between youth
|
0022| development activities and industry; and
|
0023| (f) collect data to evaluate the
|
0024| effectiveness of the system based on post-program results
|
0025| analyses."
|
0001| Section 5. A new section of the Public School Code is
|
0002| enacted to read:
|
0003| "[NEW MATERIAL] SCHOOL-TO-WORK SYSTEM.--The department
|
0004| of education shall administer the school-to-work system and
|
0005| shall:
|
0006| A. coordinate federal and state efforts regarding
|
0007| the school-to-work system;
|
0008| B. provide school-to-work staff development
|
0009| training to teachers, employers, mentors, counselors and other
|
0010| related personnel;
|
0011| C. establish procedures to encourage participation
|
0012| by students in the school-to-work system;
|
0013| D. establish procedures that assist in the
|
0014| transition of students from school to job placement sites;
|
0015| E. assist employers in developing criteria for job
|
0016| placement programs for student participants;
|
0017| F. expand career and academic counseling at
|
0018| elementary and secondary schools to include school-to-work
|
0019| system principles and methodology;
|
0020| G. adopt a school-to-work system for students with
|
0021| disabilities and for students who are at risk of dropping out
|
0022| of school; and
|
0023| H. develop long-range plans for a statewide
|
0024| school-to-work system, including plans to ensure financial
|
0025| stability of the school-to-work system in the event federal
|
0001| resources are no longer available to the department of
|
0002| education."
|
0003| Section 6. A new section of the Public School Code is
|
0004| enacted to read:
|
0005| "[NEW MATERIAL] WORK FORCE EDUCATION COORDINATING
|
0006| COUNCIL--CREATION--APPOINTMENT--MEMBERSHIP.--
|
0007| A. The "work force education coordinating council"
|
0008| is created as an advisory council to the division. The council
|
0009| shall be composed of twenty-four members representative of the
|
0010| different geographical areas of the state and reflective of the
|
0011| diverse population of the state.
|
0012| B. The president pro tempore of the senate shall
|
0013| appoint two senators, one from each of the two major political
|
0014| parties, for four-year terms or until their term of office
|
0015| expires.
|
0016| C. The speaker of the house shall appoint two
|
0017| representatives, one from each of the two major political
|
0018| parties, for two-year terms or until their term of office
|
0019| expires.
|
0020| D. The president of the state board shall appoint
|
0021| one representative of the state board to a one-year term and
|
0022| then to a four-year term.
|
0023| E. the governor shall appoint one representative
|
0024| from the governor's office to a one-year term and then to a
|
0025| four-year term.
|
0001| F. The following eighteen members shall be
|
0002| appointed jointly by the governor, the speaker of the house of
|
0003| representatives, the president pro tempore of the senate and
|
0004| the president of the state board of education:
|
0005| (1) two representatives of the division, one
|
0006| of whom shall be the division's gender equity coordinator, one
|
0007| for a two-year term and one for a four-year term;
|
0008| (2) two representatives of the labor
|
0009| department, one of whom shall be appointed from the state
|
0010| employment sector, one for a two-year term and one for a
|
0011| four-year term;
|
0012| (3) one representative of the department of
|
0013| education's vocational rehabilitation division for a four-year
|
0014| term;
|
0015| (4) one representative of a two-year
|
0016| post-secondary educational institution for a four-year term;
|
0017| (5) one representative of the economic
|
0018| development department for a four-year term;
|
0019| (6) two representatives of organized labor,
|
0020| one for a two-year term and one for a four-year term;
|
0021| (7) five representatives of the business and
|
0022| industry sector, three for a two-year term and two for a
|
0023| four-year term;
|
0024| (8) one representative of the disabled
|
0025| community for a four-year term; and
|
0001| (9) three representatives of the public
|
0002| schools, including an administrator, a teacher and a school
|
0003| counselor, two for a two-year term and one for a four-year
|
0004| term."

0005| Section 7. A new section of the Public School Code is
|
0006| enacted to read:
|
0007| "[NEW MATERIAL] COUNCIL--PURPOSE AND DUTIES.--
|
0008| A. The purpose of the council is to establish
|
0009| guidelines for the use and renewal of federal and state funds
|
0010| for the school-to-work system and guidelines for the
|
0011| implementation of the school-to-work programs developed by the
|
0012| department of education.
|
0013| B. The council shall:
|
0014| (1) make recommendations to the executive, the
|
0015| legislature and the state board regarding compliance with rules
|
0016| and regulations for the administration of federal and state
|
0017| school-to-work funds; and
|
0018| (2) recommend criteria to the department of
|
0019| education to evaluate the effectiveness of the school-to-work
|
0020| system."
|
0021| Section 8. A new section of the Public School Code is
|
0022| enacted to read:
|
0023| "[NEW MATERIAL] ANNUAL REPORT.--The department of
|
0024| education, in collaboration with the executive, shall submit a
|
0025| progress report to the legislative education study committee
|
0001| annually regarding how funds are spent for the school-to-work
|
0002| system and analyses of post-program results with data
|
0003| documenting the success of students and employers participating
|
0004| in the school-to-work system."
|
0005| Section 9. APPROPRIATION.--One hundred fifty thousand
|
0006| dollars ($150,000) is appropriated from the general fund to the
|
0007| state department of public education for expenditure in fiscal
|
0008| year 1998 to carry out the provisions of this act. Any
|
0009| unexpended or unencumbered balance remaining at the end of
|
0010| fiscal year 1998 shall revert to the general fund.
