0011| RELATING TO CRIMES; AMENDING SECTION 16-2-32 NMSA 1978 (BEING

0012| LAWS 1935, CHAPTER 57, SECTION 19, AS AMENDED) TO MAKE CHANGES

0013| IN THE EXISTING LAWS CREATING CRIMES AND ESTABLISHING PENALTIES
|
0014| FOR ACTS COMMITTED IN STATE PARK AND RECREATION AREAS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 16-2-32 NMSA 1978 (being Laws 1935,
|
0018| Chapter 57, Section 19, as amended) is amended to read:
|
0019| "16-2-32. CRIMINAL OFFENSES--PENALTY. [Each] A person
|
0020| who [shall] commits any of the following acts is guilty of a
|
0021| misdemeanor and shall be sentenced in accordance with the
|
0022| provisions of Section 31-19-1 NMSA 1978:
|
0023| A. cut, break, injure, destroy, take or remove
|
0024| [any] a tree, shrub, timber, plant or natural object in any
|
0025| state park or recreation area, except in areas designated by
|
0001| the secretary and permitted by regulations adopted by the
|
0002| secretary;
|
0003| B. kill, cause to be killed or pursue with intent
|
0004| to kill [any] a bird or animal in [any] a state park or
|
0005| recreation area, except in areas designated by the secretary
|
0006| and except in conformity with the provisions of general law and
|
0007| the regulations of the state game commission;
|
0008| C. take [any] a fish from the waters of [any]
|
0009| a state park or recreation area, except in conformity with
|
0010| the provisions of general law and the regulations of the state
|
0011| game commission;
|
0012| D. willfully mutilate, injure, deface or destroy
|
0013| any guidepost, notice, tablet, fence, enclosure or work
|
0014| [which] that is for the protection or ornamentation of
|
0015| [any] a state park or recreation area;
|
0016| E. light [any] a fire [upon any] in a state
|
0017| park or recreation area, except in [such] those places [as
|
0018| the secretary has] authorized [or] for fires by the
|
0019| secretary, willfully or carelessly permit any fire [which]
|
0020| that he has lighted or caused to be lighted or [which is]
|
0021| under his charge to spread or extend to or burn [any of] the
|
0022| shrubbery, trees, timber, ornaments or improvements [upon
|
0023| any] in a state park or recreation area or leave [any] a
|
0024| campfire [which] that he has lighted or [which] that
|
0025| has been left in his charge unattended by a competent person
|
0001| without extinguishing [the same] it;
|
0002| F. place [within any] in a state park or
|
0003| recreation area or affix to [any] an object [therein
|
0004| contained, without a written license from the secretary, any]
|
0005| in a state park or recreation area a word, character or
|
0006| device designed to advertise [any] a business, profession,
|
0007| article, thing, exhibition, matter or event without a written
|
0008| license from the secretary permitting him to do it; or
|
0009| G. violate [any] a rule or regulation adopted
|
0010| [promulgated or issued] by the secretary pursuant to the
|
0011| provisions of Chapter 16, Article 2 NMSA 1978 [shall be guilty
|
0012| of a misdemeanor and upon conviction thereof before a court of
|
0013| competent jurisdiction shall be fined not less than five dol-
|
0014|
|
0015| lars ($5.00) nor more than one hundred dollars ($100) or
|
0016| punished by imprisonment in the county jail for any term not
|
0017| more than thirty days or both such fine and imprisonment in the
|
0018| discretion of the court]."

0007| "[NEW MATERIAL] STATE PARKS DIVISION DESIGNATION.--As used

0008| in the NMSA 1978, "state park and recreation division" means the
|
0009| state parks division of the energy, minerals and natural
|
0010| resources department."".,
