0011| RELATING TO THE DWI PROGRAM FUND; MAKING AN APPROPRIATION TO
|
0012| THE DWI PROGRAM FUND SO THAT THE DEPARTMENT OF HEALTH MAY
|
0013| PROVIDE SERVICES TO PERSONS WITH TRAUMATIC BRAIN INJURIES
|
0014| SUFFERED AS THE RESULT OF ALCOHOL-RELATED MOTOR VEHICLE
|
0015| COLLISIONS.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 6-4-8 NMSA 1978 (being Laws 1993,
|
0019| Chapter 65, Section 20) is amended to read:
|
0020| "6-4-8. DWI PROGRAM FUND CREATED--APPROPRIATION.--
|
0021| A. The "DWI program fund" is created in the state
|
0022| treasury and shall be administered by the department of finance
|
0023| and administration. Money in the fund is subject to
|
0024| appropriation by the legislature to the agencies and for the
|
0025| purposes specified and in accordance with the limitations and
|
0001| requirements in this section. Balances in the fund at the end
|
0002| of any fiscal year shall not revert to the general fund.
|
0003| B. Money in the DWI program fund may be
|
0004| appropriated to any of the following agencies for the following
|
0005| purposes:
|
0006| (1) to the department of health to contract
|
0007| for community DWI programs and services, [and] for alcoholism
|
0008| and alcohol abuse prevention, screening and treatment programs
|
0009| and services pursuant to the Alcoholism and Alcohol Abuse
|
0010| Prevention, Screening and Treatment Act and to provide long-
|
0011| term care services designed to increase the independence of
|
0012| persons who survive traumatic brain injuries suffered as the
|
0013| result of alcohol-related motor vehicle collisions;
|
0014| (2) to the children, youth and families
|
0015| department to provide public school health education and
|
0016| counseling programs that emphasize alcohol abuse prevention;
|
0017| (3) to the traffic safety bureau of the state
|
0018| highway and transportation department for DWI education,
|
0019| awareness and information programs;
|
0020| (4) to the department of public safety to
|
0021| provide additional special investigators for enforcement of the
|
0022| Liquor Control Act;
|
0023| (5) to the alcohol and gaming division of the
|
0024| regulation and licensing department for enforcement of the
|
0025| provisions of the Liquor Control Act and administration of the
|
0001| Alcohol Server Education Act [if enacted into law by the first
|
0002| session of the forty-first legislature];
|
0003| (6) to the public defender department for
|
0004| costs related to workload increases due to increases in DWI
|
0005| caseloads;
|
0006| (7) to the district attorneys for costs
|
0007| related to workload increases due to increases in DWI
|
0008| caseloads;
|
0009| (8) to the magistrate courts division of the
|
0010| administrative office of the courts for magistrate court costs
|
0011| related to workload increases due to increases in DWI
|
0012| caseloads, including costs of probation services;
|
0013| (9) to the Bernalillo county metropolitan
|
0014| court for costs related to workload increases due to increases
|
0015| in DWI caseloads;
|
0016| (10) to the district courts for costs related
|
0017| to workload increases due to increases in DWI caseloads;
|
0018| (11) to the taxation and revenue department
|
0019| for DWI costs; and
|
0020| (12) to the school of medicine at the
|
0021| university of New Mexico for prevention, research and
|
0022| intervention in the field of fetal alcohol syndrome.
|
0023| C. [Prior to the second session of the forty-first
|
0024| legislature] Agencies eligible for funds under this section
|
0025| shall determine their needs for such purposes and develop
|
0001| recommendations with supporting data to justify the need for
|
0002| increased funding to expand existing programs and services or
|
0003| to implement new programs and services. The agencies shall
|
0004| develop these recommendations as part of the budget process as
|
0005| specified in Sections 6-3-18 through 6-3-22 NMSA 1978."
|
0006| Section 2. APPROPRIATION.--Two million dollars
|
0007| ($2,000,000) is appropriated from the general fund to the DWI
|
0008| program fund for expenditure in fiscal year 1998 for the
|
0009| purpose of providing the department of health with resources to
|
0010| supply long-term care services designed to increase the
|
0011| independence of persons who survive traumatic brain injuries
|
0012| suffered as the result of alcohol-related motor vehicle
|
0013| collisions. Any unexpended or unencumbered balance remaining
|
0014| at the end of fiscal year 1998 shall not revert to the general
|
0015| fund.
|
0016| Section 3. EFFECTIVE DATE.--The effective date of the
|
0017| provisions of this act is July 1, 1997.
