0011| RELATING TO COURTS; PROVIDING FOR THREE ADDITIONAL JUDGES IN
|
0012| THE BERNALILLO COUNTY METROPOLITAN COURT; PROVIDING FOR
|
0013| ADDITIONAL DISTRICT ATTORNEYS AND PUBLIC DEFENDERS; AMENDING
|
0014| SECTIONS OF THE NMSA 1978; MAKING AN APPROPRIATION.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 34-8A-4.1 NMSA 1978 (being Laws 1981,
|
0018| Chapter 318, Section 2, as amended) is amended to read:
|
0019| "34-8A-4.1. METROPOLITAN COURT JUDGES--TERMS OF OFFICE--
|
0020| ELECTION.--
|
0021| A. The elected term of office for each judge of the
|
0022| metropolitan court is four years.
|
0023| B. Judges of the metropolitan court who have been
|
0024| previously elected in a partisan election or who were serving
|
0025| as metropolitan judges on January 1, 1989 in divisions one
|
0001| through twelve shall be subject to retention or rejection on a
|
0002| nonpartisan ballot at the 1990 general election for a four-year
|
0003| term ending December 31, 1994.
|
0004| C. Any person appointed to fill a vacancy on the
|
0005| metropolitan court after January 1, 1989 shall serve until the
|
0006| next general election. That person's successor shall be chosen
|
0007| at that general election and shall hold the office until the
|
0008| general election four years later.
|
0009| D. Judges of the Bernalillo county metropolitan
|
0010| court for divisions thirteen, fourteen and fifteen shall be
|
0011| appointed and shall serve until the 1992 general election.
|
0012| Their successors shall be chosen at that general election and
|
0013| shall hold office until the general election four years later.
|
0014| Judges of the Bernalillo county metropolitan court for
|
0015| divisions sixteen, seventeen and eighteen shall be appointed
|
0016| pursuant to Article 6, Section 37 of the constitution of New
|
0017| Mexico and shall serve until the 2000 general election. Their
|
0018| successors shall be chosen at that general election and shall
|
0019| hold office until the general election four years later."
|
0020| Section 2. Section 34-8A-8 NMSA 1978 (being Laws 1979,
|
0021| Chapter 346, Section 8, as amended) is amended to read:
|
0022| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.--
|
0023| A. The name of the metropolitan court in the
|
0024| Bernalillo metropolitan district shall be the "Bernalillo
|
0025| county metropolitan court".
|
0001| B. The metropolitan court is an agency of the
|
0002| judicial department of state government. Personnel of the
|
0003| metropolitan court are subject to all laws and regulations
|
0004| applicable to state officers and agencies and state officers
|
0005| and employees, except where otherwise specifically provided by
|
0006| law.
|
0007| C. There shall be [fifteen] eighteen judges of
|
0008| the Bernalillo county metropolitan court."
|
0009| Section 3. APPROPRIATION.--
|
0010| A. One million three hundred seventy-seven thousand
|
0011| dollars ($1,377,000) is appropriated from the general fund to
|
0012| the following entities in the following amounts for expenditure
|
0013| in fiscal year 1998:
|
0014| (1) six hundred twenty-one thousand dollars
|
0015| ($621,000) to the Bernalillo county metropolitan court for the
|
0016| purpose of paying salaries and benefits and providing
|
0017| furniture, equipment and supplies for three judges and support
|
0018| staff;
|
0019| (2) two hundred eighty-seven thousand dollars
|
0020| ($287,000) to the district attorney's office for the second
|
0021| judicial district for the purpose of paying salaries and
|
0022| benefits and providing furniture, equipment and supplies for
|
0023| three assistant district attorneys and support staff; and
|
0024| (3) four hundred sixty-nine thousand dollars
|
0025| ($469,000) to the public defender department for the purpose of
|
0001| paying salaries and benefits and providing furniture, equipment
|
0002| and supplies for six public defenders and support staff.
|
0003| B. Any unexpended or unencumbered balance remaining
|
0004| at the end of fiscal year 1998 shall revert to the general
|
0005| fund.
|
0006| Section 4. EFFECTIVE DATE.--The effective date of the
|
0007| provisions of this act is July 1, 1997.
