0011| RELATING TO MOTOR VEHICLES; REGARDING ENFORCEMENT OF SEAT BELT
|
0012| USE; AMENDING A SECTION OF THE SAFETY BELT USE ACT.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 66-7-373 NMSA 1978 (being Laws 1985,
|
0016| Chapter 131, Section 4, as amended) is amended to read:
|
0017| "66-7-373. ENFORCEMENT PROGRAMS.--
|
0018| A. Failure to be secured by a child passenger
|
0019| restraint device or by a safety belt as required by the Safety
|
0020| Belt Use Act shall not in any instance constitute fault or
|
0021| negligence and shall not limit or apportion damages.
|
0022| B. The traffic safety bureau of the state highway
|
0023| and transportation department, in cooperation with the state
|
0024| department of public education and the department of health,
|
0025| shall, to the extent that funding allows, provide education to
|
0001| encourage compliance with the use of restraint devices in
|
0002| reducing the risk of harm to their users as well as to others.
|
0003| C. The traffic safety bureau of the state highway
|
0004| and transportation department shall evaluate the effectiveness
|
0005| of the Safety Belt Use Act and shall include a report of its
|
0006| findings in the annual evaluation report on its highway safety
|
0007| plan that it submits to the national highway traffic safety
|
0008| administration and the federal highway administration under 23
|
0009| U.S.C. 402.
|
0010| D. The provisions of the Safety Belt Use Act shall
|
0011| be enforced [whether or not associated with the enforcement of
|
0012| any other statute] only in association with the enforcement
|
0013| of another statute."
|
0014| Section 2. EFFECTIVE DATE.--The effective date of the
|
0015| provisions of this act is July 1, 1997.

0013| 1. On page 2, strike lines 10 through 13 in their
|
0014| entirety and insert in lieu thereof the following new
|
0015| subsections:
|

0017| "D. Except as provided in Subsection E of this
|
0018| section, the provisions of the Safety Belt Use Act shall be
|
0019| enforced whether or not associated with the enforcement of any
|
0020| other stature.
|
0021|
|
0022| E. The provisions of the Safety Belt Use Act shall
|
0023| be enforced only in association with the enforcement of another
|
0024| statute when all the occupants of a motor vehicle are eighteen
|
0025| years or age or older."".,
