0011| RELATING TO BICYCLE RACING; CREATING THE BICYCLE RACING FUND;
|
0012| PROVIDING FOR THE TERMINATION OF THE BICYCLE RACING COMMISSION
|
0013| AND THE REPEAL OF THE BICYCLE RACING ACT PURSUANT TO THE SUNSET
|
0014| ACT.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 60-2D-1 NMSA 1978 (being Laws 1991,
|
0018| Chapter 233, Section 1) is amended to read:
|
0019| "60-2D-1. SHORT TITLE.--[This act] Chapter 60, Article
|
0020| 2D NMSA 1978 may be known as the "Bicycle Racing Act"."
|
0021| Section 2. A new Section 60-2D-4.1 NMSA 1978 is enacted
|
0022| to read:
|
0023| "60-2D-4.1. [NEW MATERIAL] BICYCLE RACING FUND
|
0024| CREATED--DISPOSITION.--
|
0025| A. The "bicycle racing fund" is created in the
|
0001| state treasury. The fund shall consist of all license fees,
|
0002| charges and other revenue received by the commission, less
|
0003| amounts paid to the state treasurer pursuant to Section 60-2D-
|
0004| 15 NMSA 1978, and all appropriations, gifts, devises, grants
|
0005| and donations made to the fund. Money in the fund may be
|
0006| expended by the commission pursuant to appropriation by the
|
0007| legislature and budgets approved by the state budget division.
|
0008| Interest accruing to the fund through investment of the fund
|
0009| shall remain in the fund. Money in the fund shall not revert
|
0010| at the end of a fiscal year.
|
0011| B. The fund shall be administered by the
|
0012| commission. Disbursements from the fund shall be made only
|
0013| upon warrant drawn by the secretary of finance and
|
0014| administration pursuant to vouchers signed by the chairman of
|
0015| the commission or his designee."
|
0016| Section 3. A new Section 60-2D-19 NMSA 1978 is enacted to
|
0017| read:
|
0018| "60-2D-19. [NEW MATERIAL] TERMINATION OF COMMISSION
|
0019| LIFE--DELAYED REPEAL.--The bicycle racing commission is
|
0020| terminated July 1, 1999 pursuant to the Sunset Act. The
|
0021| commission shall continue to operate pursuant to the provisions
|
0022| of the Bicycle Racing Act until July 1, 2000. Effective July
|
0023| 1, 2000, Chapter 60, Article 2D NMSA 1978 is repealed."

0006| receive per diem and mileage as provided in the Per Diem and Mileage
|
0007| Act and shall receive no other compensation, perquisite or allowance.

0009| B. The commission shall maintain an office within the state
|
0010| and keep detailed records of all its meetings and all business
|
0011| transacted by it. Complete records shall be kept of all collections
|
0012| and disbursements. The commission shall report annually on June 30 to
|
0013| the governor on its activities for the preceding year.
|

|
0015| [C. The expenses of the commission shall be paid out of
|
0016| the state's allocation of the proceeds from the bicycle-racing
|
0017| pari-mutuel tax as provided in Section 16 of the Bicycle Racing
|
0018| Act. Payment of expenses by the commission shall be on vouchers
|
0019| issued and signed by the person designated by the commission, upon
|
0020| warrants drawn by the department of finance and administration in
|
0021| accordance with the budget approved by the department of finance
|
0022| and administration.]"".
