0011| RELATING TO EDUCATION; ENACTING THE PROFESSIONAL DEVELOPMENT
|
0012| ACT; MAKING APPROPRIATIONS.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. A new section of the Public School Code is
|
0016| enacted to read:
|
0017| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0018| the "Professional Development Act"."
|
0019| Section 2. A new section of the Public School Code is
|
0020| enacted to read:
|
0021| "[NEW MATERIAL] PURPOSE OF ACT.--It is the purpose of
|
0022| the Professional Development Act to:
|
0023| A. establish a framework for professional
|
0024| development within the department of education to facilitate
|
0025| statewide planning and adoption of professional development
|
0001| programs in school districts to ensure that New Mexico public
|
0002| schools have a quality work force;
|
0003| B. provide school personnel with a variety of
|
0004| professional development opportunities and ongoing support to
|
0005| ensure integration of effective teaching strategies, learning
|
0006| technologies and use of resources in the educational process to
|
0007| enhance student learning and performance; and
|
0008| C. establish a funding mechanism that supports the
|
0009| development of an effective school personnel work force for the
|
0010| benefit of all students in New Mexico."
|
0011| Section 3. A new section of the Public School Code is
|
0012| enacted to read:
|
0013| "[NEW MATERIAL] STATE BOARD DUTIES--PROFESSIONAL
|
0014| DEVELOPMENT PLANS.--The state board shall:
|
0015| A. administer the provisions of the Professional
|
0016| Development Act;
|
0017| B. develop and adopt, in cooperation with school
|
0018| districts and their communities, a professional development
|
0019| framework with criteria for schools and school districts to use
|
0020| in creating plans for professional development consistent with
|
0021| school, school district, state and national goals that will
|
0022| enhance student achievement and performance;
|
0023| C. assist schools and school districts to develop a
|
0024| comprehensive plan based on the state board's planning
|
0025| framework;
|
0001| D. develop and administer a process for the review
|
0002| and approval of school district professional development plans;
|
0003| and
|
0004| E. distribute funds to school districts upon
|
0005| approval of each school district's professional development
|
0006| plan as addressed in its educational plan for student success."
|
0007| Section 4. A new section of the Public School Code is
|
0008| enacted to read:
|
0009| "[NEW MATERIAL] SCHOOL DISTRICTS--PROFESSIONAL
|
0010| DEVELOPMENT PLANS.--
|
0011| A. A school district shall adopt and implement a
|
0012| professional development plan for its local school board and
|
0013| all administrators, teachers and other personnel employed by
|
0014| the district. The professional development plan shall be
|
0015| updated annually to ensure that the proposed plan is consistent
|
0016| with national, state and school district goals and objectives.
|
0017| B. Each school district shall submit a proposed
|
0018| professional development plan to the state board that meets
|
0019| state board professional development guidelines and standards.
|
0020| C. Proposed professional development plans shall:
|
0021| (1) be developed in collaboration with
|
0022| certified and noncertified school personnel;
|
0023| (2) show evidence of how the plans will
|
0024| enhance student academic achievement and support the attainment
|
0025| of school district, state and national goals; and
|
0001| (3) include a parent and community involvement
|
0002| component and appropriate evaluation procedures.
|
0003| D. Proposed professional development plans shall be
|
0004| designed to respond to local needs and may include the
|
0005| following:
|
0006| (1) standards-based educational reform
|
0007| innovations that will assist in the attainment of national and
|
0008| state educational goals and content standards, with benchmarks
|
0009| and supporting assessment practices;
|
0010| (2) knowledge and skills to assist teachers in
|
0011| meeting the individual needs of students, the needs of limited
|
0012| language-proficient students and the complex challenges
|
0013| encountered in the classroom;
|
0014| (3) knowledge and skills to assist in the use
|
0015| of technology in education and technology applications that
|
0016| will enhance student learning and professional development,
|
0017| such as technology-enhanced curricula and instruction and
|
0018| administrative resources and services for the public schools;
|
0019| (4) professional development activities to
|
0020| assist teachers in preparing for national certification through
|
0021| the national board for professional teaching standards;
|
0022| (5) career ladder programs for educational
|
0023| assistants and noncertified school employees to improve job-
|
0024| related skills; and
|
0025| (6) methods to successfully implement
|
0001| inclusion, transition and unified systems to meet the local
|
0002| needs of all students with developmental disabilities."
|
0003| Section 5. APPROPRIATIONS.--
|
0004| A. Four million five hundred fifty-five thousand
|
0005| dollars ($4,555,000) is appropriated from the general fund to
|
0006| the state department of public education for expenditure in
|
0007| fiscal years 1998 and 1999 for the purpose of making
|
0008| distributions on a per unit basis to school districts to
|
0009| implement approved professional development plans. Any
|
0010| unexpended or unencumbered balance remaining at the end of
|
0011| fiscal year 1999 shall revert to the general fund.
|
0012| B. Four hundred forty-five thousand dollars
|
0013| ($445,000) is appropriated from the general fund to the state
|
0014| department of public education for expenditure in fiscal year
|
0015| 1998 for the purpose of making an equal distribution to each
|
0016| school district to design a professional development plan. Any
|
0017| unexpended or unencumbered balance remaining at the end of
|
0018| fiscal year 1998 shall revert to the general fund.
