0011| RELATING TO CHILD FATALITIES; ESTABLISHING A CHILD FATALITY
|
0012| REVIEW TEAM; MAKING AN APPROPRIATION.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. CHILD FATALITY REVIEW TEAM--MEMBERSHIP--
|
0016| DUTIES.--
|
0017| A. There is created the "child fatality review
|
0018| team" consisting of a representative from:
|
0019| (1) the department of health;
|
0020| (2) the office of the medical investigator;
|
0021| (3) the state department of public education;
|
0022| (4) the children, youth and families
|
0023| department;
|
0024| (5) the traffic safety bureau of the state
|
0025| highway and transportation department;
|
0001| (6) the school of medicine of the university
|
0002| of New Mexico;
|
0003| (7) the New Mexico office of Indian affairs;
|
0004| (8) the department of public safety;
|
0005| (9) a statewide organization of district
|
0006| attorneys;
|
0007| (10) a statewide organization of medical
|
0008| physicians; and
|
0009| (11) a statewide child advocacy organization.
|
0010| B. The representatives of state agencies shall be
|
0011| appointed by the respective heads of those agencies. Members
|
0012| of the public shall be appointed by the secretary of health in
|
0013| consultation with the office of the medical investigator.
|
0014| C. The child fatality review team shall organize
|
0015| itself into specialized panels based on categories of
|
0016| preventable causes of child fatalities for the purpose of:
|
0017| (1) identifying preventable deaths and factors
|
0018| in those deaths and monitoring trends and analyses as causes
|
0019| and contributing factors of child fatalities;
|
0020| (2) identifying statewide and community system
|
0021| needs and preventable system failures affecting child
|
0022| fatalities;
|
0023| (3) identifying the need for improvement in
|
0024| service delivery practices among community providers; and
|
0025| (4) providing a mechanism for the
|
0001| dissemination of information for the development of local and
|
0002| state public health programs, public policies and provider
|
0003| training programs; the making of recommendations for changes in
|
0004| consumer products; and the pooling of resources for the
|
0005| prevention of child fatalities.
|
0006| D. Meetings of the child fatality review team shall
|
0007| not be subject to the Open Meetings Act, and records of the
|
0008| team shall be confidential pursuant to the provisions of
|
0009| Section
|
0010| 24-1-20 NMSA 1978. The team shall be deemed a review
|
0011| organization for the purposes of the Review Organization
|
0012| Immunity Act.
|
0013| E. The department of health, on behalf of the child
|
0014| fatality review team, shall enter into appropriate interagency
|
0015| agreements for the purpose of securing records and information
|
0016| necessary to complete the work of the team.
|
0017| F. The department of health shall provide staff
|
0018| assistance and administrative support to the child fatality
|
0019| review team to carry out the team's duties.
|
0020| G. The child fatality review team shall elect
|
0021| annually a chairman and such other officers as are deemed
|
0022| necessary. Meetings shall be held at least quarterly.
|
0023| Section 2. APPROPRIATION.--Sixty thousand dollars
|
0024| ($60,000) is appropriated from the general fund to the
|
0025| department of health for expenditure in fiscal year 1998 for
|
0001| the purpose of establishing the child fatality review team and
|
0002| for costs associated with its duties. Any unexpended or
|
0003| unencumbered balance remaining at the end of fiscal years 1998
|
0004| shall revert to the general fund.
