0013| COORDINATING COUNCIL; ENACTING THE STRATEGIC PLANNING

0014| COORDINATING COUNCIL ACT; MAKING APPROPRIATIONS; DECLARING AN
|
0015| EMERGENCY.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. SHORT TITLE.--This act may be cited as the
|
0019| "Strategic Planning Coordinating Council Act".
|
0020| Section 2. FINDINGS AND PURPOSE.--
|
0021| A. The legislature finds that the mission of the
|
0022| council as stated in the strategic plan is to provide the
|
0023| highest quality elementary and secondary education in New
|
0024| Mexico to develop in students the knowledge and skills
|
0025| necessary for responsible citizenship, productive employment
|
0001| and satisfying lives.
|
0002| B. The legislature finds that the mission of public
|
0003| education is best accomplished by implementing the objectives
|
0004| and achieving the goals outlined in the strategic plan.
|
0005| C. The legislature finds that involving all
|
0006| branches of government and the public in the educational
|
0007| process will achieve widespread understanding of and support
|
0008| for the strategic plan.
|
0009| D. It is the purpose of the Strategic Planning
|
0010| Coordinating Council Act to establish a process to ensure the
|
0011| continuous enhancement and implementation of the strategic plan
|
0012| by:
|
0013| (1) evaluating results, including the annual
|
0014| assessment, review and revision of the strategic plan;
|
0015| (2) integrating the school districts' current
|
0016| budget activities by using both the budget cycle and
|
0017| educational plan for student success to implement the strategic
|
0018| plan; and
|
0019| (3) encouraging all branches of government and
|
0020| the public to work together toward New Mexico's mission of
|
0021| public education.
|
0022| Section 3. DEFINITIONS.--As used in the Strategic
|
0023| Planning Coordinating Council Act:
|
0024| A. "council" means the strategic planning
|
0025| coordinating council; and
|
0001| B. "strategic plan" means the New Mexico public
|
0002| education strategic plan.
|
0003| Section 4. STRATEGIC PLAN.--The strategic plan shall
|
0004| provide:
|
0005| A. a well-defined vision and articulated steps to
|
0006| achieve national preeminence in education;
|
0007| B. a means to gain statewide consensus by
|
0008| encouraging the legislature, the governor's office and related
|
0009| state agencies, the state board of education, the state
|
0010| department of public education, the local school boards, school
|
0011| personnel, parents, students, the business community and school
|
0012| districts to work together toward the common goal of improving
|
0013| educational opportunities and performance of all New Mexico's
|
0014| children; and
|
0015| C. coordination of the state-level planning cycle
|
0016| with the budgeting cycle.
|
0017| Section 5. STRATEGIC PLANNING COORDINATING COUNCIL.--
|
0018| A. The "strategic planning coordinating council" is
|
0019| created.
|
0020| B. The council shall be composed of fifteen
|
0021| members. The members shall be representative of the different
|
0022| geographical areas of the state and reflective of the diverse
|
0023| population of the state.
|
0024| C. The president pro tempore of the senate shall
|
0025| appoint two members and the speaker of the house of
|
0001| representatives shall appoint two members.
|
0002| D. Eleven members shall be appointed as follows:
|
0003| (1) the president of the state board of
|
0004| education shall appoint one member to a two-year term and one
|
0005| member to a four-year term;
|
0006| (2) the governor shall appoint two members to
|
0007| a two-year term and one member to a four-year term; and
|
0008| (3) the governor, the speaker of the house of
|
0009| representatives, the president pro tempore of the senate and
|
0010| the president of the state board of education shall jointly
|
0011| appoint three members to a two-year term and three members to a
|
0012| four-year term.
|
0013| E. After the initial appointments, members who are
|
0014| not legislators shall be appointed for four-year terms, and
|
0015| members who are legislators shall be appointed for four-year
|
0016| terms or until their term of office expires.
|
0017| F. Members of the council, except for members who
|
0018| are legislators, may be reimbursed as provided in the Per Diem
|
0019| and Mileage Act and shall receive no other compensation,
|
0020| perquisite or allowance.
|
0021| Section 6. DUTIES.--The council shall:
|
0022| A. make recommendations to the legislature, the
|
0023| governor and the state board of education for the enhancement
|
0024| and implementation of the strategic plan and for the
|
0025| development of the priorities to be implemented yearly;
|
0001| B. make recommendations to the legislature, the
|
0002| governor and the state board of education for the development
|
0003| of a variety of formal and informal mechanisms to involve the
|
0004| public in this process;
|
0005| C. review the planning efforts conducted by the
|
0006| school districts and make recommendations to the legislature,
|
0007| the governor and the state board of education on the evaluation
|
0008| and revision of the strategic plan in response to public input;
|
0009| D. direct staff in the development of
|
0010| recommendations of proposed revisions of the strategic plan;
|
0011| E. submit the revised strategic plan to the
|
0012| legislative education study committee, the office of the
|
0013| governor and the state board of education with an analysis of
|
0014| the new priorities, including cost of implementation,
|
0015| recommendations regarding necessary legislation for
|
0016| implementation of the goals and objectives of the strategic
|
0017| plan and a recommended annual budget for the council's
|
0018| activities; and
|
0019| F. report at least annually to the legislature, the
|
0020| governor, the state board of education and the public on the
|
0021| progress in achieving and implementing the goals and objectives
|
0022| of the strategic plan.
|
0023| Section 7. STAFF MANAGEMENT TEAM--DUTIES.--The council
|
0024| shall be staffed by a staff management team composed of three
|
0025| staff members. The director of the legislative education study
|
0001| committee staff, the superintendent of public instruction and
|
0002| the office of the governor shall each designate a staff member
|
0003| to work with the council. The staff shall assist the council
|
0004| in carrying out its duties as specified in Section 6 of the
|
0005| Strategic Planning Coordinating Council Act and shall serve as
|
0006| liaison to their appointing agencies.
|
0007| Section 8. ADMINISTRATION.--The legislative education
|
0008| study committee, in cooperation with the state board of
|
0009| education and the governor's office, shall be the
|
0010| administrative agency for the council. The legislative
|
0011| education study committee, in consultation with the state board
|
0012| of education and the governor's office, may contract for
|
0013| strategic planning assistance.
|
0014| Section 9. APPROPRIATION.--Seventy thousand dollars
|
0015| ($70,000) is appropriated from the general fund to the state
|
0016| department of public education for expenditure in fiscal years
|
0017| 1997 and 1998 for the purpose of funding personnel for the
|
0018| staff management team of the strategic planning coordinating
|
0019| council. Any unexpended or unencumbered balance remaining at
|
0020| the end of fiscal year 1998 shall revert to the general fund.
|
0021| Section 10. APPROPRIATION.--Seventy thousand dollars
|
0022| ($70,000) is appropriated from the general fund to the
|
0023| department of finance and administration for expenditure in
|
0024| fiscal years 1997 and 1998 for the purpose of funding personnel
|
0025| for the staff management team of the strategic planning
|
0001| coordinating council. Any unexpended or unencumbered balance
|
0002| remaining at the end of fiscal year 1998 shall revert to the
|
0003| general fund.
|
0004| Section 11. APPROPRIATION.--Eight-two thousand dollars
|
0005| ($82,000) is appropriated from the general fund to the
|
0006| legislative education study committee for expenditure in fiscal
|
0007| years 1997 and 1998 for the purpose of funding personnel for
|
0008| the staff management team of the strategic planning
|
0009| coordinating council and for the purpose of paying per diem and
|
0010| travel expenses for members of the strategic planning
|
0011| coordinating council. Any unexpended or unencumbered balance
|
0012| remaining at the end of fiscal year 1998 shall revert to the
|
0013| general fund.
|
0014| Section 12. EMERGENCY.--It is necessary for the public
|
0015| peace, health and safety that this act take effect immediately.
