0011| RELATING TO PUBLIC PURCHASES; AMENDING THE PROCUREMENT CODE TO

0012| INCREASE THE DOLLAR LIMIT FOR SMALL PURCHASE PROCUREMENTS BY

0013| STATE AGENCIES.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 13-1-125 NMSA 1978 (being Laws 1984,
|
0017| Chapter 65, Section 98, as amended) is amended to read:
|
0018| "13-1-125. SMALL PURCHASES.--
|
0019| A. The [state purchasing agent or] central
|
0020| purchasing office within a local public body shall procure
|
0021| services, construction or items of tangible personal property
|
0022| having a value not exceeding five thousand dollars ($5,000) in
|
0023| accordance with the applicable small purchase regulations
|
0024| adopted by [the secretary] a local public body or a central
|
0025| purchasing office that has the authority to issue regulations.
|
0001| B. Notwithstanding the requirements of Subsection A
|
0002| of this section, a central purchasing office may procure
|
0003| professional services having a value not exceeding twenty
|
0004| thousand dollars ($20,000), excluding applicable state and
|
0005| local gross receipts taxes, except for the services of
|
0006| architects, landscape architects, engineers or surveyors for
|
0007| state public works projects or local public works projects, in
|
0008| accordance with professional services procurement regulations
|
0009| promulgated by the department of finance and administration,
|
0010| the general services department or a central purchasing office
|
0011| with the authority to issue regulations.
|
0012| C. Notwithstanding the requirements of Subsection A
|
0013| of this section, a state agency or a central purchasing
|
0014| office for [a state educational institution named in Article
|
0015| 12, Section 11 of the constitution of New Mexico, for a state
|
0016| two-year post-secondary institution or for] a school district
|
0017| as defined in the Public School Code may procure services,
|
0018| construction or items of tangible personal property having a
|
0019| value not exceeding ten thousand dollars ($10,000) in
|
0020| accordance with the applicable small purchase regulations
|
0021| promulgated by the secretary or a central purchasing office
|
0022| with the authority to issue regulations.
|
0023| D. Notwithstanding the requirements of Subsection A
|
0024| of this section, a state agency or a local public body may
|
0025| procure services, construction or items of tangible personal
|
0001| property having a value not exceeding five hundred dollars
|
0002| ($500) by issuing a direct purchase order to a contractor based
|
0003| upon the best obtainable price.
|
0004| E. Procurement requirements shall not be
|
0005| artificially divided so as to constitute a small purchase under
|
0006| this section."
