0001| AN ACT | 0002| RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE OF | 0003| DISARMING A PEACE OFFICER; PROVIDING A PENALTY; ENACTING A NEW | 0004| SECTION OF THE CRIMINAL CODE. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. A new section of the Criminal Code is enacted to read: | 0008| "DISARMING A PEACE OFFICER.-- | 0009| A. Disarming a peace officer consists of knowingly: | 0010| (1) removing a firearm or weapon from the person of a peace officer when | 0011| the officer is acting within the scope of his duties; or | 0012| (2) depriving a peace officer of the use of a firearm or weapon when the | 0013| officer is acting within the scope of his duties. | 0014| B. The provisions of Subsection A of this act shall not apply when a peace officer | 0015| is engaged in criminal conduct. | 0016| C. Whoever commits disarming a peace officer is guilty of a third degree felony." | 0017| Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is | 0018| July 1, 1997. |
