0001| SENATE JOINT MEMORIAL 1 | 0002| 42ND LEGISLATURE - STATE OF NEW MEXICO - FIRST SPECIAL | 0003| SESSION, 1996 | 0004| INTRODUCED BY | 0005| TOM RUTHERFORD | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT MEMORIAL | 0012| REQUESTING THE GOVERNOR TO TRANSFER HAZARDOUS WASTE AUTHORITY | 0013| FROM THE DEPARTMENT OF ENVIRONMENT TO THE OIL CONSERVATION | 0014| DIVISION OF THE ENERGY, MINERALS AND NATURAL RESOURCES | 0015| DEPARTMENT. | 0016| | 0017| WHEREAS, the oil conservation division of the energy, | 0018| minerals and natural resources department currently regulates | 0019| the oil and gas industry; and | 0020| WHEREAS, hazardous wastes that are created by the oil and | 0021| gas industry during exploration, production and processing are | 0022| regulated by the department of environment; and | 0023| WHEREAS, the oil conservation division and the department | 0024| of environment are negotiating an interagency agreement to | 0025| transfer responsibility for regulating oil and gas hazardous | 0001| wastes; | 0002| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0003| STATE OF NEW MEXICO that the governor be requested to expedite | 0004| negotiations between the energy, minerals and natural resources | 0005| department and the department of environment to transfer | 0006| authority for regulation of oil and gas hazardous wastes from | 0007| the department of environment to the oil conservation division, | 0008| to the extent such authority for a transfer is provided in law, | 0009| and report on progress and effectiveness of the transfer to the | 0010| appropriate legislative committee by December 1, 1998; and | 0011| BE IT FURTHER RESOLVED that copies of this memorial be | 0012| transmitted to the governor and to the secretaries of | 0013| environment and energy, minerals and natural resources. | 0014| - 2 - |
