0012| PROPOSING AN AMENDMENT TO ARTICLE 9, SECTION 14 OF THE
|
0013| CONSTITUTION OF NEW MEXICO TO PERMIT THE LEGISLATURE TO
|
0014| ESTABLISH A PROGRAM TO MAKE GRANTS TO INDIVIDUALS AND BUSINESSES
|
0015| TO PURCHASE ALTERNATIVE FUEL VEHICLES.
|

0017| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. It is proposed to amend Article 9, Section 14
|
0019| of the constitution of New Mexico to read:
|
0020| "Neither the state nor any county, school district or
|
0021| municipality, except as otherwise provided in this constitution,
|
0022| shall directly or indirectly lend or pledge its credit or make
|
0023| any donation to or in aid of any person, association or public
|
0024| or private corporation or in aid of any private enterprise for
|
0025| the construction of any railroad; provided:
|
0001| A. nothing in this section shall be construed to
|
0002|
|
0003| prohibit the state or any county or municipality from making
|
0004| provision for the care and maintenance of sick and indigent
|
0005| persons;
|
0006| B. nothing in this section shall prohibit the state
|
0007| from establishing a veterans' scholarship program for Vietnam
|
0008| conflict veterans who are post-secondary students at educational
|
0009| institutions under the exclusive control of the state by
|
0010| exempting such veterans from the payment of tuition. For the
|
0011| purposes of this subsection, a "Vietnam conflict veteran" is any
|
0012| person who has been honorably discharged from the armed forces
|
0013| of the United States, who was a resident of New Mexico at the
|
0014| original time of entry into the armed forces from New Mexico and
|
0015| who has been awarded a Vietnam campaign medal for service in the
|
0016| armed forces of this country in Vietnam during the period from
|
0017| August 5, 1964 to the official termination date of the Vietnam
|
0018| conflict as designated by executive order of the president of
|
0019| the United States;
|
0020| C. the state may also establish by law a program of
|
0021| loans to students of the healing arts, as defined by law, for
|
0022| residents of the state who, in return for the payment of
|
0023| educational expenses, contract with the state to practice their
|
0024| profession for a period of years after graduation within areas
|
0025| of the state designated by law; [and]
|
0001| D. nothing in this section shall be construed to
|
0002| prohibit the state or a county or municipality from creating new
|
0003|
|
0004| job opportunities by providing land, buildings or infrastructure
|
0005| for facilities to support new or expanding businesses if this
|
0006| assistance is granted pursuant to general implementing
|
0007| legislation that is approved by a majority vote of those elected
|
0008| to each house of the legislature. The implementing legislation
|
0009| shall include adequate safeguards to protect public money or
|
0010| other resources used for the purposes authorized in this
|
0011| subsection. The implementing legislation shall further provide
|
0012| that:
|
0013| (1) each specific county or municipal project
|
0014| providing assistance pursuant to this subsection need not be
|
0015| approved by the legislature but shall be approved by the county
|
0016| or municipality pursuant to procedures provided in the
|
0017| implementing legislation; and
|
0018| (2) each specific state project providing
|
0019| assistance pursuant to this subsection shall be approved by law;
|
0020| and
|
0021| E. the legislature may by law establish a program
|
0022| to provide an incentive to encourage individuals and businesses
|
0023| to purchase alternative fuel vehicles by making grants to
|
0024| purchasers of alternative fuel vehicles in the amount of the
|
0025| difference in the wholesale cost between the alternative fuel
|
0001| vehicle and the identical conventional fuel vehicle."
|
0002| Section 2. The amendment proposed by this resolution shall
|
0003| be submitted to the people for their approval or rejection at
|
0004| the next general election or at any special election prior to
|
0005| that date which may be called for that purpose.
