0012| PROPOSING AN AMENDMENT TO ARTICLE 9, SECTION 14 OF THE

0013| CONSTITUTION OF NEW MEXICO TO ALLOW COUNTIES AND LOCAL
|
0014| GOVERNMENTS TO DONATE PUBLIC LAND FOR PRIVATE OR PUBLIC HOUSING
|
0015| INITIATIVES.

0017| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. It is proposed to amend Article 9, Section 14
|
0019| of the constitution of New Mexico to read:
|
0020| "Neither the state nor any county, school district or
|
0021| municipality, except as otherwise provided in this constitution,
|
0022| shall directly or indirectly lend or pledge its credit or make
|
0023| any donation to or in aid of any person, association or public
|
0024| or private corporation or in aid of any private enterprise for
|
0025| the construction of any railroad; provided:
|
0001| A. nothing in this section shall be construed to
|
0002| prohibit the state or any county or municipality from making
|
0003| provision for the care and maintenance of sick and indigent
|
0004| persons;
|
0005| B. nothing in this section shall prohibit the state
|
0006| from establishing a veterans' scholarship program for Vietnam
|
0007| conflict veterans who are post-secondary students at educational
|
0008| institutions under the exclusive control of the state by
|
0009| exempting such veterans from the payment of tuition. For the
|
0010| purposes of this subsection, a "Vietnam conflict veteran" is any
|
0011| person who has been honorably discharged from the armed forces
|
0012| of the United States, who was a resident of New Mexico at the
|
0013| original time of entry into the armed forces from New Mexico and
|
0014| who has been awarded a Vietnam campaign medal for service in the
|
0015| armed forces of this country in Vietnam during the period from
|
0016| August 5, 1964 to the official termination date of the Vietnam
|
0017| conflict as designated by executive order of the president of
|
0018| the United States;
|
0019| C. the state may also establish by law a program of
|
0020| loans to students of the healing arts, as defined by law, for
|
0021| residents of the state who, in return for the payment of
|
0022| educational expenses, contract with the state to practice their
|
0023| profession for a period of years after graduation within areas
|
0024| of the state designated by law; [and]
|
0025| D. nothing in this section shall be construed to
|
0001| prohibit the state or a county or municipality from creating new
|
0002| job opportunities by providing land, buildings or infrastructure
|
0003| for facilities to support new or expanding businesses if this
|
0004| assistance is granted pursuant to general implementing
|
0005| legislation that is approved by a majority vote of those elected
|
0006| to each house of the legislature. The implementing legislation
|
0007| shall include adequate safeguards to protect public money or
|
0008| other resources used for the purposes authorized in this
|
0009| subsection. The implementing legislation shall further provide
|
0010| that:
|
0011| (1) each specific county or municipal project
|
0012| providing assistance pursuant to this subsection need not be
|
0013| approved by the legislature but shall be approved by the county
|
0014| or municipality pursuant to procedures provided in the
|
0015| implementing legislation; and
|
0016| (2) each specific state project providing
|
0017| assistance pursuant to this subsection shall be approved by law;
|
0018| and
|
0019| E. nothing in this section shall be construed to
|
0020| prohibit a county, municipality or political subdivision of the
|
0021| state from donating public land for housing."
|
0022| Section 2. The amendment proposed by this resolution shall
|
0023| be submitted to the people for their approval or rejection at
|
0024| the next general election or at any special election prior to
|
0025| that date which may be called for that purpose.
