0012|     PROPOSING AN AMENDMENT TO ARTICLE 12, SECTION 6 OF THE
    |
0013|     CONSTITUTION OF NEW MEXICO TO PROVIDE FOR THE APPOINTMENT RATHER
    |
0014|     THAN THE ELECTION OF STATE BOARD OF EDUCATION MEMBERS, TO REDUCE
    |
0015|     THE SIZE OF THE STATE BOARD OF EDUCATION AND TO LENGTHEN THE
    |
0016|     TERM OF ITS MEMBERS.

0018|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0019|       Section 1.  It is proposed to amend Article 12, Section 6
    |
0020|     of the constitution of New Mexico to read:
    |
0021|            "A.  There is hereby created a "state department of
    |
0022|     public education" and a "state board of education".  The state
    |
0023|     board of education shall determine public school policy and
    |
0024|     vocational educational policy and shall have control, management
    |
0025|     and direction, including financial direction, distribution of
    |
0001|     school funds and financial accounting for all public schools,
    |
0002|     pursuant to authority and powers provided by law.  The board
    |
0003|     shall appoint a qualified, experienced educational administrator
    |
0004|     to be known as the superintendent of public instruction, who
    |
0005|     shall, subject to the policies established by the board, direct
    |
0006|     the operation of the state department of public education.
    |
0007|            B. <s>[Ten members of the state board of education who
</s>    |
<s></s>0008| <s>    shall be state officers shall be elected for staggered terms of
</s>    |
<s></s>0009| <s>    four years as provided by law.]</s>  Board members shall be
    |
0010|     residents of the <s>[board of education]</s> district from which they
    |
0011|     are <s>[elected]</s> <u>appointed</u>.  Change of residence of a board
    |
0012|     member to a place outside the district from which <s>[he was
</s>    |
<s></s>0013| <s>    elected]</s> <u>the member was appointed</u> shall automatically
    |
0014|     terminate the <s>[term]</s> <u>service</u> of that member <u>and create a
</u>    |
<u></u>0015| <u>    vacancy in that position. Appointments to fill such a vacancy
</u>    |
<u></u>0016| <u>    shall be for the remainder of the unexpired term</u>.
    |
0017|            C. <s>[Five members of the state board of education who
</s>    |
<s></s>0018| <s>    shall be state officers]</s> <u>Members of the board</u> shall be
    |
0019|     nominated and by and with the consent of the senate appointed by
    |
0020|     the governor <s>[from five districts substantially equal in
</s>    |
<s></s>0021| <s>    population]</s> for staggered <s>[four-year]</s> <u>six-year</u> terms <s>[as
</s>    |
<s></s>0022| <s>    provided by law.  Those appointed by the governor]</s> <u>with three
</u>    |
<u></u>0023| <u>    members being appointed from each congressional district. 
</u>    |
<u></u>0024| <u>    Members of the state board</u> shall be qualified electors of the
    |
0025|     state of New Mexico, no more than one-half or a simple majority
    |
0001|     of whom at the time of their appointment shall be members of the
    |
0002|     same political party. <s>[After 1990, the number of appointed
</s>    |
<s></s>0003| <s>    members may be changed by law not to exceed five members.
</s>    |
<s></s>0004| <s>           D.  The governor shall fill vacancies on the board by
</s>    |
<s></s>0005| <s>    appointment of a resident from the district in which the vacancy
</s>    |
<s></s>0006| <s>    occurs until the next regular election for membership on the
</s>    |
<s></s>0007| <s>    board.
</s>    |
<s></s>0008| <s>           E.  Upon adoption of this amendment, all functions
</s>    |
<s></s>0009| <s>    relating to the distribution of school funds and financial
</s>    |
<s></s>0010| <s>    accounting for the public schools shall be transferred to the
</s>    |
<s></s>0011| <s>    state department of public education to be performed as provided
</s>    |
<s></s>0012| <s>    by law.]</s> <u>Members of the board shall not be removed except for
</u>    |
<u></u>0013| <u>    incompetence, neglect of duty or malfeasance in office</u>."
    |
0014|       Section 2.  The amendment proposed by this resolution shall
    |
0015|     be submitted to the people for their approval or rejection at
    |
0016|     the next general election or at any special election prior to
    |
0017|     that date which may be called for that purpose.
