0012| PROPOSING AN AMENDMENT TO ARTICLE 12, SECTION 6 OF THE
|
0013| CONSTITUTION OF NEW MEXICO TO PROVIDE FOR THE APPOINTMENT RATHER
|
0014| THAN THE ELECTION OF STATE BOARD OF EDUCATION MEMBERS, TO REDUCE
|
0015| THE SIZE OF THE STATE BOARD OF EDUCATION AND TO LENGTHEN THE
|
0016| TERM OF ITS MEMBERS.

0018| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. It is proposed to amend Article 12, Section 6
|
0020| of the constitution of New Mexico to read:
|
0021| "A. There is hereby created a "state department of
|
0022| public education" and a "state board of education". The state
|
0023| board of education shall determine public school policy and
|
0024| vocational educational policy and shall have control, management
|
0025| and direction, including financial direction, distribution of
|
0001| school funds and financial accounting for all public schools,
|
0002| pursuant to authority and powers provided by law. The board
|
0003| shall appoint a qualified, experienced educational administrator
|
0004| to be known as the superintendent of public instruction, who
|
0005| shall, subject to the policies established by the board, direct
|
0006| the operation of the state department of public education.
|
0007| B. [Ten members of the state board of education who
|
0008| shall be state officers shall be elected for staggered terms of
|
0009| four years as provided by law.] Board members shall be
|
0010| residents of the [board of education] district from which they
|
0011| are [elected] appointed. Change of residence of a board
|
0012| member to a place outside the district from which [he was
|
0013| elected] the member was appointed shall automatically
|
0014| terminate the [term] service of that member and create a
|
0015| vacancy in that position. Appointments to fill such a vacancy
|
0016| shall be for the remainder of the unexpired term.
|
0017| C. [Five members of the state board of education who
|
0018| shall be state officers] Members of the board shall be
|
0019| nominated and by and with the consent of the senate appointed by
|
0020| the governor [from five districts substantially equal in
|
0021| population] for staggered [four-year] six-year terms [as
|
0022| provided by law. Those appointed by the governor] with three
|
0023| members being appointed from each congressional district.
|
0024| Members of the state board shall be qualified electors of the
|
0025| state of New Mexico, no more than one-half or a simple majority
|
0001| of whom at the time of their appointment shall be members of the
|
0002| same political party. [After 1990, the number of appointed
|
0003| members may be changed by law not to exceed five members.
|
0004| D. The governor shall fill vacancies on the board by
|
0005| appointment of a resident from the district in which the vacancy
|
0006| occurs until the next regular election for membership on the
|
0007| board.
|
0008| E. Upon adoption of this amendment, all functions
|
0009| relating to the distribution of school funds and financial
|
0010| accounting for the public schools shall be transferred to the
|
0011| state department of public education to be performed as provided
|
0012| by law.] Members of the board shall not be removed except for
|
0013| incompetence, neglect of duty or malfeasance in office."
|
0014| Section 2. The amendment proposed by this resolution shall
|
0015| be submitted to the people for their approval or rejection at
|
0016| the next general election or at any special election prior to
|
0017| that date which may be called for that purpose.
