0012|     PROPOSING AN AMENDMENT TO ARTICLE 9, SECTION 10 OF THE

0013|     CONSTITUTION OF NEW MEXICO TO AUTHORIZE COUNTIES TO BORROW MONEY
    |
0014|     TO ACQUIRE REAL ESTATE FOR OPEN SPACE.

0016|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  It is proposed to amend Article 9, Section 10
    |
0018|     of the constitution of New Mexico to read:
    |
0019|       "No county shall borrow money except for the following
    |
0020|     purposes:
    |
0021|            A.  erecting, remodeling and making additions to
    |
0022|     necessary public buildings;
    |
0023|            B.  constructing or repairing public roads and
    |
0024|     bridges;
    |
0025|            C.  constructing or acquiring a system for supplying
    |
0001|         water, including the acquisition of water and water rights,necessary real estate or rights of way and easements;
    |
0002|            D.  constructing or acquiring a sewer system,
    |
0003|     including the necessary real estate or rights of way and
    |
0004|     easements; 
    |
0005|            E.  constructing an airport or sanitary landfill,
    |
0006|     including the necessary real estate; <s>[or]</s>
    |
0007|            <u>F.  acquiring necessary real estate for open space;
</u>    |
<u></u>0008| <u>    or
</u>    |
<u></u>0009| <u>    </u>      <s>[F.]</s> <u>G.</u>  the purchase of books and other library
    |
0010|     resources for libraries in the county.
    |
0011|       In such cases, indebtedness shall be incurred only after
    |
0012|     the proposition to create such debt has been submitted to the
    |
0013|     registered voters of the county and approved by a majority of
    |
0014|     those voting thereon.  No bonds issued for such purpose shall
    |
0015|     run for more than fifty years.  Provided, however, that no money
    |
0016|     derived from general obligation bonds issued and sold hereunder
    |
0017|     shall be used for maintaining existing buildings and, if so,
    |
0018|     such bonds shall be invalid."
    |
0019|       Section 2.  The amendment proposed by this resolution shall
    |
0020|     be submitted to the people for their approval or rejection at
    |
0021|     the next general election or at any special election prior to
    |
0022|     that date which may be called for that purpose.
