0012|     PROPOSING TO AMEND ARTICLE 10 OF THE CONSTITUTION OF NEW MEXICO

0013|     BY ADDING A NEW SECTION TO PROVIDE FOR RECALL OF ELECTED COUNTY

0016|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  It is proposed to amend Article 10 of the
    |
0018|     constitution of New Mexico by adding a new section to read:
    |
0019|       "Any elected official of a county is subject to recall by
    |
0020|     the voters of the county for malfeasance, misfeasance or abuse
    |
0021|     of office.  The recall petition shall be filed with the county
    |
0022|     clerk of the county and shall be signed by registered voters of
    |
0023|     the county.  The signatures shall be not less in number than
    |
0024|     twenty-five percent of the number of votes cast for the elected
    |
0025|     official sought to be recalled in the last preceding general
    |
0001|     election at which the official was elected.  Upon verification
    |
0002|     of the signatures on the petition, the county clerk shall place
    |
0003|     the question of recall of the elected county official on the
    |
0004|     ballot within ninety days.  No petition of recall of an elected
    |
0005|     county official shall be submitted more than twice during the
    |
0006|     term for which the official was elected.  A separate petition
    |
0007|     shall be filed for each elected county official sought to be
    |
0008|     recalled.  If at the general election a majority of the votes
    |
0009|     cast on the question of recall are in favor of the recall of an
    |
0010|     elected county official, that official is recalled from office,
    |
0011|     and a vacancy in the office shall be filled in the manner
    |
0012|     provided by law.  The provisions of this section are self-executing."
    |
0013|       Section 2.  The amendment proposed by this resolution shall
    |
0014|     be submitted to the people for their approval or rejection at
    |
0015|     the next general election or at any special election prior to
    |
0016|     that date which may be called for that purpose.
