PERLS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A CONCURRENT RESOLUTION | 0012| AMENDING LEGISLATIVE JOINT RULE 3-1 TO PROVIDE THAT CONFERENCE | 0013| COMMITTEES BE SUBJECT TO THE OPEN MEETINGS ACT. | 0014| | 0015| WHEREAS, Legislative Joint Rule 8-1 provides that joint | 0016| rules may be adopted, amended or repealed by concurrent | 0017| resolution approved by two-thirds of the membership of each | 0018| house; | 0019| NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF | 0020| REPRESENTATIVES, THE SENATE CONCURRING THEREIN, that Joint Rule | 0021| 3-1 be amended to read: | 0022| "CONFERENCE COMMITTEES (3-1) | 0023| A. If one house refuses to concur in the | 0024| amendments made to its bill by the other house, the chief | 0025| clerk shall notify the house making the amendments of that | 0001| refusal to concur and ask that it recede from its | 0002| amendments. If the amending house refuses to recede from | 0003| its amendments, a conference committee, consisting of three | 0004| members from each house, shall be appointed by the | 0005| president pro tempore of the senate and the speaker of the | 0006| house. | 0007| B. The conference committee shall meet at a time | 0008| to be mutually agreed upon by the committee members, and | 0009| the time and place of the meeting shall be printed on the | 0010| daily schedule of house and senate committee hearings or | 0011| posted in the capitol in such a way as to give, under the | 0012| circumstances, reasonably adequate notice of the meeting to | 0013| the public. | 0014| C. When agreement on the amendments in dispute has | 0015| been reached, the members shall report to their respective | 0016| houses, or, if agreement has not been reached, they shall | 0017| report that fact to their respective houses. [No new item | 0018| shall be presented as an amendment for inclusion in the | 0019| conference committee report unless the item has been the | 0020| subject of a legislative committee hearing during the | 0021| session.] Voting in the conference committee shall be by | 0022| the respective houses, and a majority of the membership | 0023| from each house is required for adoption of a | 0024| recommendation. The report of the conference committee | 0025| shall not be subject to amendment in either house. The | 0001| report of the conference committee shall always be in order | 0002| except during a roll call or when a question of order or a | 0003| motion to adjourn is pending. The report of the conference | 0004| committee shall not be voted on in either house until at | 0005| least twenty-four hours after the time the conference | 0006| committee report has been reported to the respective house, | 0007| except for conference committee reports that are received | 0008| in the last twenty-four hours of a session, in which case | 0009| at least one legislative day must lapse between receipt of | 0010| the conference committee report by the house and a vote on | 0011| the report. | 0012| D. Conference committees are subject to the | 0013| provisions of the Open Meetings Act, except for | 0014| requirements related to time periods for meeting notices, | 0015| publication of agendas and minutes. | 0016| E. Conference committees shall only consider | 0017| matters included in the house or senate versions of the | 0018| bill. Conference committees shall not agree to new terms or | 0019| provisions not included in the house or senate versions of | 0020| the bill. Conference committees shall not recommend | 0021| funding levels greater than the amount included in either | 0022| the house or senate version of the bill.". | 0023|  |
