0012| PROPOSING TO AMEND ARTICLE 11 OF THE CONSTITUTION OF NEW MEXICO

0013| BY ABOLISHING THE STATE CORPORATION COMMISSION AND CREATING A
|
0014| SINGLE REGULATORY AGENCY FOR CORPORATIONS, PUBLIC UTILITIES,
|
0015| TRANSPORTATION COMPANIES, TRANSMISSION AND PIPELINE COMPANIES,
|
0016| INSURANCE COMPANIES AND OTHER PUBLIC SERVICES AS PROVIDED BY
|
0017| LAW.
|

0019| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0020| Section 1. It is proposed to amend Article 11 of the
|
0021| constitution of New Mexico by repealing Sections 1 through 12
|
0022| and 15 through 17.
|
0023| Section 2. It is proposed to amend Article 11 of the
|
0024| constitution of New Mexico by adding a new Section 1 to read:
|
0025| "The "public regulation commission" is created. The
|
0001| commission shall consist of five members elected for staggered
|
0002| four-year terms beginning on January 1 of the year following
|
0003| their election; provided that those chosen at the first general
|
0004| election after the adoption of this section shall immediately
|
0005| classify themselves by lot, so that two of them shall hold
|
0006| office for two years and three of them for four years; and
|
0007| further provided that, after serving two terms, members shall be
|
0008| ineligible to hold office as a commission member until one full
|
0009| term has intervened. No commissioner or candidate for the
|
0010| commission shall accept anything of value from a person or
|
0011| entity whose charges for services to the public are regulated by
|
0012| the commission."
|
0013| Section 3. It is proposed to amend Article 11 of the
|
0014| constitution of New Mexico by adding a new Section 2 to read:
|
0015| "The public regulation commission shall have responsibility
|
0016| for chartering and regulating business corporations in such
|
0017| manner as the legislature shall provide. The commission shall
|
0018| have responsibility for regulating public utilities, including
|
0019| electric, natural gas and water companies; transportation
|
0020| companies, including common and contract carriers; transmission
|
0021| and pipeline companies, including telephone, telegraph and
|
0022| information transmission companies; insurance companies and
|
0023| others engaged in risk assumption; and other public service
|
0024| companies in such manner as the legislature shall provide."
|
0025| Section 4. The provisions of Sections 1 and 3 of this
|
0001| amendment shall take effect January 1, 1999.
|
0002| Section 5. The amendment proposed by this resolution shall
|
0003| be submitted to the people for their approval or rejection at
|
0004| the next general election or at any special election prior to
|
0005| that date which may be called for that purpose.
