PERLS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A JOINT RESOLUTION | 0012| PROPOSING AMENDMENTS TO ARTICLE 4, SECTIONS 4 AND 10 OF THE | 0013| CONSTITUTION OF NEW MEXICO TO LIMIT THE TERMS OF LEGISLATORS, | 0014| PROVIDE FOR COMPENSATION TO LEGISLATORS AND PROHIBIT CERTAIN | 0015| GIFTS TO LEGISLATORS. | 0016| | 0017| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. It is proposed to amend Article 4, Section 4 of | 0019| the constitution of New Mexico to read: | 0020| "Members of the legislature shall be elected as follows: | 0021| [those senators from Bernalillo, Chaves, Curry, DeBaca, Grant, | 0022| Lea, Lincoln, Luna, Sandoval, San Juan, San Miguel, Socorro, | 0023| Taos, Torrance, Union and Valencia counties for a term of six | 0024| years starting January 1, 1961, and after serving such terms | 0025| shall be elected for a term of four years thereafter; those | 0001| senators from all other counties for the terms] senators for | 0002| terms of four years, and members of the house of | 0003| representatives for [a term] terms of two years. [They] | 0004| Excluding service in the legislature prior to the first session | 0005| of the forty-third legislature, or an appointment to a vacant | 0006| office, no legislator shall serve more than three consecutive | 0007| terms in the senate and six consecutive terms in the house of | 0008| representatives. Senators and members of the house of | 0009| representatives shall be elected on the day provided by law for | 0010| holding the general election of state officers or | 0011| representatives in congress. If a vacancy occurs in the office | 0012| of senator or member of the house of representatives, for any | 0013| reason, the county commissioners of the county wherein the | 0014| vacancy occurs shall fill such vacancy by appointment. | 0015| Such legislative appointments as provided in this section | 0016| shall be for a term ending on December 31, subsequent to the | 0017| next succeeding general election." | 0018| Section 2. It is proposed to amend Article 4, Section 10 | 0019| of the constitution of New Mexico to read: | 0020| "A. Each member of the legislature shall receive: | 0021| [A. as per diem expense the sum of not more than | 0022| seventy-five dollars ($75.00) for each day's attendance during | 0023| each session, as provided by law, and twenty-five cents ($.25) | 0024| for each mile traveled in going to and returning from the seat | 0025| of government by the usual traveled route, once each session as | 0001| defined by Article 4, Section 5 of this constitution;] | 0002| (1) an annual salary in an amount equal to | 0003| twenty percent of the governor's annual salary; | 0004| (2) per diem expense for each day's attendance | 0005| during a legislative session at the same rate as other elected | 0006| state officials are paid for conducting official duties away | 0007| from their official offices; | 0008| [B.] (3) per diem expense [and mileage] | 0009| at the same [rates] rate as provided in [Subsection A] | 0010| Paragraph (2) of this [section] subsection for service at | 0011| meetings required by legislative committees established by the | 0012| legislature to meet in the interim between sessions; and | 0013| (4) mileage at the internal revenue service | 0014| standard mileage rate for each mile traveled in going to and | 0015| returning from the seat of government by the usually traveled | 0016| route, once during each session of the legislature and mileage | 0017| at that same rate for each mile traveled for service at meetings | 0018| required by legislative committees established by the | 0019| legislature to meet in the interim between sessions. | 0020| [C.] B. A member of the legislature shall | 0021| receive no other compensation, perquisite or allowance. | 0022| C. A member of the legislature shall not accept | 0023| anything of a value in excess of twenty-five dollars ($25.00) | 0024| from a lobbyist, as that term may be defined by law." | 0025| Section 3. The amendment proposed by this resolution shall | 0001| be submitted to the people for their approval or rejection at | 0002| the next general election or at any special election prior to | 0003| that date which may be called for that purpose. | 0004| - - | 0005| |
