0012| REVISING THE CONSTITUTIONAL AMENDMENT PROCESS BY PROVIDING
|
0013| ADDITIONAL METHODS FOR VOTERS TO AMEND THE CONSTITUTION AND
|
0014| DIRECTING THE SECRETARY OF STATE TO INFORM VOTERS ABOUT
|
0015| CONSTITUTIONAL AMENDMENTS.
|

|
0017| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. It is proposed to amend Article 19, Section 1
|
0019| of the constitution of New Mexico to read:
|
0020| "[Any] An amendment or amendments to this constitution
|
0021| may be proposed in either house of the legislature at [any]
|
0022| a regular session [thereof]; and if a majority of all
|
0023| members elected to each of the two houses voting separately
|
0024| [shall vote] votes in favor thereof [such], the proposed
|
0025| amendment or amendments shall be entered on their respective
|
0001| journals with the yeas and nays thereon.
|
0002| An amendment or amendments may also be proposed by an
|
0003| independent commission established by law for that purpose, and
|
0004| the amendment or amendments shall be submitted to the
|
0005| legislature for approval or disapproval, provided that the
|
0006| amendment or amendments may not be altered or further amended by
|
0007| the legislature; if approved by the legislature in accordance
|
0008| with the provisions of this section, the amendment or amendments
|
0009| proposed by the independent commission shall be submitted to the
|
0010| electors.
|
0011| The secretary of state shall [cause any such amendment or
|
0012| amendments to be published in at least one newspaper in every
|
0013| county of the state, where a newspaper is published once each
|
0014| week, for four consecutive weeks, in English and Spanish when
|
0015| newspapers in both of said languages are published in such
|
0016| counties, the last publication to be not more than two weeks
|
0017| prior to the election at which time said amendment or amendments
|
0018| shall be submitted to the electors of the state for their
|
0019| approval or rejection; and the said amendment or amendments]
|
0020| provide notice of the content and purpose of legislatively
|
0021| approved constitutional amendments in both English and Spanish
|
0022| to inform electors about the amendments in the time and manner
|
0023| provided by law. Amendments approved by the legislature shall
|
0024| be voted upon at the next regular election held [in said
|
0025| state] after the adjournment of [the] that legislature
|
0001| [proposing such amendment or amendments] or at [such] a
|
0002| special election to be held not less than six months after the
|
0003| adjournment of [said] that legislature, at such time and in
|
0004| such manner as [said] the legislature may by law provide.
|
0005| [If the same be] An amendment that is ratified by a majority
|
0006| of the electors voting [thereon such amendment or amendments]
|
0007| on the amendment shall become part of this constitution.
|
0008| If two or more amendments are [proposed] initiated by
|
0009| the legislature, they shall be so submitted as to enable the
|
0010| electors to vote on each of them separately. [provided, that no
|
0011| amendment shall apply to or affect the provisions of]
|
0012| Amendments initiated by an independent commission created by
|
0013| law for that purpose may be submitted by the commission
|
0014| separately or as a single ballot question. No amendment shall
|
0015| restrict the rights created by Sections One and Three of
|
0016| Article VII hereof, on elective franchise, and Sections Eight
|
0017| and Ten of Article XII hereof, on education, unless it be
|
0018| proposed by vote of three-fourths of the members elected to each
|
0019| house and be ratified by a vote of the people of this state in
|
0020| an election at which at least three-fourths of the electors
|
0021| voting [in the whole state and at least two-thirds of those
|
0022| voting in each county in the state shall vote for such] on the
|
0023| amendment vote in favor of that amendment."
|
0024| Section 2. It is proposed to amend Article 19, Section 2
|
0025| of the constitution of New Mexico to read:
|
0001| "Whenever [during the first twenty-five years after the
|
0002| adoption of this constitution] the legislature, [by a three-fourths vote of the members elected to each house, or, after the
|
0003| expiration of said period of twenty-five years] by a two-thirds
|
0004| vote of the members elected to each house, [shall deem]
|
0005| deems it necessary to call a convention to revise or amend
|
0006| this constitution, they shall submit the question of calling
|
0007| such convention to the electors at the next general election,
|
0008| and if a majority of all the electors voting on such questions
|
0009| at said election in the state [shall vote] votes in favor of
|
0010| calling a convention, the legislature shall, at the next
|
0011| session, provide by law for calling the same. Such convention
|
0012| shall consist of at least as many delegates as there are members
|
0013| of the house of representatives. [The constitution adopted by
|
0014| such convention shall have no validity until it has been
|
0015| submitted to and ratified by the people]
|
0016| Revisions or amendments proposed by a constitutional
|
0017| convention shall be submitted to the voters of the state at an
|
0018| election held on a date set by the convention. The revisions or
|
0019| amendments proposed by the convention may be submitted in whole
|
0020| or in part, or with alternatives, as determined by the
|
0021| convention. If a majority vote favors a proposal or
|
0022| alternative, it is adopted and becomes effective thirty days
|
0023| after the certification of the election returns unless otherwise
|
0024| provided by the convention."
|
0025| Section 3. It is proposed to amend Article 19 of the
|
0001| constitution of New Mexico by repealing Section 5.
|
0002| Section 4. The amendment proposed by this resolution shall
|
0003| be submitted to the people for their approval or rejection at
|
0004| the next general election or at any special election prior to
|
0005| that date which may be called for that purpose.
