0012| REQUESTING THE UNITED STATES CONGRESS TO REAUTHORIZE THE

0013| INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991 AND
|
0014| INCREASE THE FUNDING LEVEL FOR THE INDIAN ROADS CONSTRUCTION
|
0015| FUND TO THREE HUNDRED MILLION DOLLARS ($300,000,000) PER YEAR IN
|
0016| THE REUTHORIZATION OF THAT ACT IN FISCAL YEAR 1997 AND
|
0017| REQUESTING A FUNDING ALLOCATION OF THIRTY-THREE PERCENT OR MORE
|
0018| OF THE TOTAL INDIAN ROADS CONSTRUCTION FUNDS FOR THE NAVAJO
|
0019| NATION.
|

|
0021| WHEREAS, through various treaties and acts of congress, the
|
0022| federal government has promised Indian tribes certain goods and
|
0023| services, one of which is transportation services, to serve the
|
0024| social and economic needs of Indian tribes; and
|
0025| WHEREAS, Indian tribes are totally dependent on the federal
|
0001| transportation programs for their transportation needs due to
|
0002| the Indian tribes not being eligible under federal law to
|
0003| administer federal highway trust funds directly or eligible to
|
0004| receive a portion of fuel revenue collected on Indian
|
0005| reservations for transportation purposes; and
|
0006| WHEREAS, there is a critical need to improve transportation
|
0007| services on the Indian reservations throughout the United States
|
0008| to promote economic development, improve health care, enhance
|
0009| education and increase employment; and
|
0010| WHEREAS, the Indian tribes and pueblos recognize and
|
0011| appreciate the support the transportation programs have
|
0012| contributed to the success of many social and economic
|
0013| development efforts on all Indian reservations; and
|
0014| WHEREAS, pursuant to the Surface Transportation Assistance
|
0015| Act of 1982, the United States secretary of transportation is to
|
0016| allocate funds authorized to be appropriated for Indian
|
0017| reservation roads in accordance with the relative needs of the
|
0018| various Indian reservations;
|
0019| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0020| STATE OF NEW MEXICO that the United States congress be requested
|
0021| to reauthorize the Intermodal Surface Transportation Efficiency
|
0022| Act of 1991 and to increase the funding level of the Indian
|
0023| roads construction fund to three hundred million dollars
|
0024| ($300,000,000) per year in the reauthorization of that act in
|
0025| fiscal year 1997; and
|
0001| BE IT FURTHER RESOLVED that because of the importance of
|
0002| increasing the level of funding for Indian roads construction,
|
0003| the legislature request the bureau of Indian affairs to continue
|
0004| the relative needs distribution formula and to provide a funding
|
0005| allocation of thirty-three percent or more of the total Indian
|
0006| roads construction fund for the Navajo area for construction of
|
0007| roads on the Navajo nation; and
|
0008| BE IT FURTHER RESOLVED that copies of this memorial be
|
0009| transmitted to the president of the United States, the New
|
0010| Mexico congressional delegation, the United States secretary of
|
0011| the interior, the Navajo nation council and the president of the
|
0012| Navajo nation.
