0012| REQUESTING THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY TO
|
0013| INSPECT THE POJOAQUE PUEBLO SEWAGE TREATMENT FACILITY TO
|
0014| DETERMINE COMPLIANCE WITH THE CLEAN WATER ACT OF 1977.
|

0016| WHEREAS, all New Mexico citizens, including those living on
|
0017| Native American pueblo and reservation lands, are concerned
|
0018| about the quality of life; and
|
0019| WHEREAS, all New Mexico citizens, including those living on
|
0020| Native American pueblo and reservation lands, are concerned
|
0021| about clean air, clean water and public health; and
|
0022| WHEREAS, environmental contaminants do not recognize
|
0023| political jurisdictional boundaries; and
|
0024| WHEREAS, New Mexico is in a desert region, water is limited
|
0025| and clean water is a precious resource all are responsible for
|
0001| protecting; and
|
0002| WHEREAS, the Pojoaque valley has severe problems from water
|
0003| contamination; and
|
0004| WHEREAS, the United States environmental protection agency
|
0005| has primacy over clean water in the Pojoaque valley;
|
0006| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0007| STATE OF NEW MEXICO that the United States environmental
|
0008| protection agency be requested to inspect the Pojoaque pueblo
|
0009| sewage treatment facility to determine whether it complies with
|
0010| the Clean Water Act of 1977; and
|
0011| BE IT FURTHER RESOLVED that if the environmental protection
|
0012| agency determines that the Pojoaque pueblo sewage treatment
|
0013| system violates the Clean Water Act of 1977, that corrective
|
0014| action, consistent with tribal sovereignty, state sovereignty
|
0015| and federal law, be taken immediately; and
|
0016| BE IT FURTHER RESOLVED that the New Mexico legislative
|
0017| council be requested to direct the appropriate interim
|
0018| legislative committee to receive testimony on water quality in
|
0019| the Pojoaque valley and recommend appropriate action to the
|
0020| legislature by January 1, 1997; and
|
0021| BE IT FURTHER RESOLVED that copies of this memorial be
|
0022| transmitted to the United States environmental protection agency
|
0023| and the New Mexico legislative council.
