0012| RELATING TO JUDICIAL PROCEEDINGS; ESTABLISHING AN ANSWER FEE FOR

0013| CIVIL ACTIONS IN TRIAL COURTS; GRANTING FREE PROCESS TO

0014| ANSWERING PARTIES IN CIVIL ACTIONS UPON A SHOWING OF INDIGENCY;
|
0015| CREATING A FUND; DEDICATING PROCEEDS IN THE FUND FOR THE
|
0016| PROVISION OF CIVIL LEGAL SERVICES TO INDIGENT PERSONS; MAKING AN
|
0017| APPROPRIATION.
|

|
0019| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0020| Section 1. Section 34-6-40 NMSA 1978 (being Laws 1968,
|
0021| Chapter 69, Section 42, as amended) is amended to read:
|
0022| "34-6-40. FINANCE--FEES.--
|
0023| A. District court clerks shall collect in civil
|
0024| matters docketing any cause, whether original or reopened or by
|
0025| appeal or transfer from any inferior court, a fee of seventy-two
|
0001| dollars ($72.00).
|
0002| B. District court clerks shall collect an answer
|
0003| fee of twenty-five dollars ($25.00) from a party that answers a
|
0004| complaint, a third-party complaint, a counter-claim or a cross-claim in a civil action. The district court may waive the
|
0005| answer fee for a party in a civil action upon a proper showing
|
0006| of indigency. The proceeds of the answer fee shall be deposited
|
0007| in the civil legal services fund.
|
0008| [B.] C. No fees or costs shall be taxed against
|
0009| the state, its political subdivisions or the nonprofit
|
0010| corporations authorized to be formed under the Educational
|
0011| Assistance Act.
|
0012| [C.] D. Except as otherwise specifically
|
0013| provided by law, docket fees shall be paid into the general
|
0014| fund."
|
0015| Section 2. Section 35-6-1 NMSA 1978 (being Laws 1968,
|
0016| Chapter 62, Section 92, as amended) is amended to read:
|
0017| "35-6-1. MAGISTRATE COSTS--SCHEDULE--DEFINITION OF
|
0018| "CONVICTED".--
|
0019| A. [Each magistrate] Magistrates, including
|
0020| metropolitan court judges, shall collect the following costs:
|
0021| Docket fee, criminal actions under Section 29-5-1
|
0022| NMSA 1978 . . . . . . . . . . . . . . . . . . . $ 1.00
|
0023| Docket fee, to be collected prior to docketing any
|
0024| other criminal action, except as provided in Subsection B of
|
0025| Section 35-6-3 NMSA 1978 . . . . . . . . . . . . 20.00

0001| Docket fee, to be collected prior to docketing any
|
0002| civil action, except as provided in Subsection A of Section
|
0003| 35-6-3 NMSA 1978 . . . . . . . . . . . . . . . . 37.00

0004| Answer fee, to be collected from a party that

0005| answers a complaint, a third-party complaint, a counter-claim or
|
0006| a cross-claim in a civil action . . . . . . . . . . . . . .

|
0008| The proceeds of the answer fee shall be deposited in the civil
|
0009| legal services fund.
|
0010| Jury fee, to be collected from the party demanding
|
0011| trial by jury in any civil action at the time the demand is
|

0013| Copying fee, for making and certifying copies of any
|
0014| records in the court, for each page copied by photographic
|

0018| Proceeds from this copying fee shall be transferred to the
|
0019| administrative office of the courts for deposit in the court
|
0020| automation fund.
|
0021| Except as otherwise specifically provided by law,
|
0022| docket fees shall be paid into the general fund.
|
0023| B. Except as otherwise provided by law, no other
|
0024| costs or fees shall be charged or collected in the magistrate
|
0025| or metropolitan court.
|
0001| C. The magistrate or metropolitan court may grant
|
0002| free process to any party in any civil proceeding or special
|
0003| statutory proceeding upon a proper showing of indigency. The
|
0004| magistrate or metropolitan court may deny free process if it
|
0005| finds that the complaint on its face does not state a cause of
|
0006| action.
|
0007| D. As used in this subsection, "convicted" means
|
0008| the defendant has been found guilty of a criminal charge by the
|
0009| magistrate or metropolitan judge, either after trial, a plea of
|
0010| guilty or a plea of nolo contendere. [Each magistrate]
|
0011| Magistrates, including metropolitan court judges, shall
|
0012| collect the following costs:
|
0013| (1) corrections fee, to be collected upon
|
0014| conviction from persons convicted of violating any provision of
|
0015| the Motor Vehicle Code involving the operation of a motor
|
0016| vehicle, convicted of a crime constituting a misdemeanor or a
|
0017| petty misdemeanor or convicted of violating any ordinance that
|
0018| may be enforced by the imposition of a term of
|
0019| imprisonment . . . . . . . . . . . . . . . . $10.00;
|
0020| (2) court automation fee, to be collected
|
0021| upon conviction from persons convicted of violating any
|
0022| provision of the Motor Vehicle Code involving the operation of
|
0023| a motor vehicle. . . . . . . . . . . . . . . . 3.00;

0024| (3) traffic safety fee, to be collected upon
|
0025| conviction from persons convicted of violating any provision of
|
0001| the Motor Vehicle Code involving the operation of a motor
|
0002| vehicle. . . . . . . . . . . . . . . . . . . . 3.00;
|
0003| and
|
0004| (4) judicial education fee, to be collected
|
0005| upon conviction from persons convicted of operating a motor
|
0006| vehicle in violation of the Motor Vehicle Code, convicted of a
|
0007| crime constituting a misdemeanor or a petty misdemeanor or
|
0008| convicted of violating any ordinance punishable by a term of
|
0009| imprisonment . . . . . . . . . . . . . . . . . 1.00.
|
0010| E. Metropolitan court judges shall collect as costs
|
0011| a mediation fee not to exceed five dollars ($5.00) for the
|
0012| docketing of small claims and criminal actions specified by
|
0013| metropolitan court rule. Proceeds of the mediation fee shall
|
0014| be deposited into the metropolitan court mediation fund."
|
0015| Section 3. [NEW MATERIAL] CIVIL LEGAL SERVICES FUND
|
0016| CREATED--ADMINISTRATION--DISTRIBUTION.--
|
0017| A. There is created in the state treasury the
|
0018| "civil legal services fund" to be administrated by the
|
0019| administrative office of the courts.
|
0020| B. Balances in the civil legal services fund may be
|
0021| expended by the administrative office of the courts for the
|
0022| purpose of entering into contracts with nonprofit organizations
|
0023| to provide free or reduced-fee civil legal services to indigent
|
0024| persons in New Mexico. A contract entered into for the purpose
|
0025| of providing civil legal services to indigent persons shall be
|
0001| in accordance with the provisions of the Procurement Code.
|
0002| C. Balances in the civil legal services fund shall
|
0003| not revert to the general fund at the end of any fiscal year.
|
0004| D. Payments from the civil legal services fund
|
0005| shall be made upon vouchers issued and signed by the director
|
0006| of the administrative office of the courts upon warrants drawn
|
0007| by the secretary of finance and administration.
|
0008| Section 4. EFFECTIVE DATE.--The effective date of the
|
0009| provisions of this act is July 1, 1996.
