0012| RELATING TO GAMING; CREATING A TASK FORCE TO DEVELOP

0013| RECOMMENDATIONS FOR A TRIBAL-STATE PARTNERSHIP FOR OPERATING AND
|
0014| REGULATING GAMING ACTIVITIES; MAKING AN APPROPRIATION; DECLARING
|
0015| AN EMERGENCY.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. TASK FORCE CREATED--MEMBERSHIP--DUTIES.--
|
0019| A. The "gaming task force" is created. In creating
|
0020| this body, it is the intent of the legislature that a forum for
|
0021| discussion and negotiation of the complex issues of tribal and
|
0022| nontribal gaming will provide a much-needed deliberative process
|
0023| that can benefit all of the citizens of the state.
|
0024| B. The gaming task force consists of seven members.
|
0025| In appointing a member, the appointing authority shall select
|
0001| individuals who have demonstrated expertise in the subject of
|
0002| gaming. Members shall be appointed as follows:
|
0003| (1) two citizens, one of whom shall be a member
|
0004| of an Indian nation, tribe or pueblo, to be appointed by the
|
0005| governor with the consent of the senate;
|
0006| (2) two citizens, one of whom shall be a member
|
0007| of an Indian nation, tribe or pueblo, to be appointed by the
|
0008| speaker of the house of representatives;
|
0009| (3) two citizens, one of whom shall be a member
|
0010| of an Indian nation, tribe or pueblo, to be appointed by the
|
0011| president pro tempore of the senate; and
|
0012| (4) one citizen to be appointed by majority
|
0013| vote of the other six members of the task force.
|
0014| C. The gaming task force shall elect one of its
|
0015| members as chairman and shall meet at the call of the chairman
|
0016| or at the request of a majority of the members.
|
0017| D. The gaming task force shall exist until the first
|
0018| day of the first session of the forty-third legislature in
|
0019| January 1997, on which date it shall terminate.
|
0020| E. The gaming task force shall make a report with
|
0021| recommendations for proposed legislation, if any, to the first
|
0022| session of the forty-third legislature.
|
0023| F. The gaming task force shall study and deliberate
|
0024| to develop a gaming activities plan for the state that shall
|
0025| provide for state and tribal sharing in the conduct and
|
0001| regulation of and the revenue from both tribal and nontribal
|
0002| gaming activities with the objective of providing strictly
|
0003| regulated gaming that will produce funds to be used for economic
|
0004| development, fulfilling both tribal and state interests.
|
0005| G. Twenty-five thousand dollars ($25,000) is
|
0006| appropriated from the general fund to the legislative council
|
0007| service for expenditure in the 1996 and 1997 fiscal years to pay
|
0008| the expenses incurred for the activities of the gaming task
|
0009| force. Staff for the task force shall be provided by the
|
0010| legislative council service. Members of the task force shall be
|
0011| reimbursed for attendance at meetings of the task force pursuant
|
0012| to the provisions of the Per Diem and Mileage Act. Any
|
0013| unexpended or unencumbered balance remaining at the end of
|
0014| fiscal year 1997 shall revert to the general fund.

0015| Section 2. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect immediately.
