0012| RELATING TO THE LIVESTOCK BOARD; AMENDING THE DELAYED REPEAL

0013| TERMINATING THE NEW MEXICO LIVESTOCK BOARD; TRANSFERING ASSETS,

0014| OBLIGATIONS, POWERS AND DUTIES TO THE NEW MEXICO DEPARTMENT OF
|
0015| AGRICULTURE.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 77-2-6 NMSA 1978 (being Laws 1977,
|
0019| Chapter 256, Section 3) is amended to read:
|
0020| "77-2-6. NEW MEXICO LIVESTOCK BOARD ATTACHED TO NEW
|
0021| MEXICO DEPARTMENT OF AGRICULTURE.--
|
0022| A. The New Mexico livestock board is attached for
|
0023| coordinative purposes to the New Mexico department of
|
0024| agriculture. The board shall execute a memorandum of
|
0025| understanding with the director of the New Mexico department of
|
0001| agriculture identifying areas for cooperation and coordination
|
0002| of the activities of the board with those of the New Mexico
|
0003| department of agriculture. Administrative and other services
|
0004| may be provided the board by the department pursuant to the
|
0005| terms of the memorandum of understanding. The board shall
|
0006| submit an annual report on its activites to the director. This
|
0007| section shall not be construed to affect the exercise of any
|
0008| board power or duty.
|
0009| B. Effective July 1, 1998, the New Mexico
|
0010| department of agriculture shall assume the powers, duties,
|
0011| assets and obligations of the New Mexico livestock board. The
|
0012| secretary of agriculture shall establish a livestock division in
|
0013| the department and that division shall be responsible for
|
0014| oversight of the livestock industry in New Mexico."
|
0015| Section 2. Section 77-2-28 NMSA 1978 (being Laws 1981,
|
0016| Chapter 5, Section 1, as amended) is amended to read:
|
0017| "77-2-28. TERMINATION OF BOARD LIFE--DELAYED REPEAL.--The
|
0018| New Mexico livestock board is terminated [July 1, 1999] July
|
0019| 1, 1997 unless continued by the legislature pursuant to the
|
0020| Sunset Act. The board shall continue to operate according to
|
0021| all of the provisions of Chapter 77, Article 2 NMSA 1978 until
|
0022| [July 1, 2000] July 1, 1998 for the purpose of winding up
|
0023| its affairs. Effective [July 1, 2000] July 1, 1998, Chapter
|
0024| 77, Article 2 NMSA 1978 is repealed."
