0012| RELATING TO CRIMINAL SENTENCES; CLARIFYING THAT A PERSON MAY BE
|
0013| SENTENCED TO SERVE CONSECUTIVE SENTENCES FOR BOTH MURDER IN THE
|
0014| FIRST DEGREE AND THE UNDERLYING FELONY; AMENDING A SECTION OF
|
0015| THE CRIMINAL SENTENCING ACT.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 31-18-14 NMSA 1978 (being Laws 1979,
|
0019| Chapter 150, Section 1, as amended) is amended to read:
|
0020| "31-18-14. SENTENCING AUTHORITY--CAPITAL FELONIES.--
|
0021| A. When a defendant has been convicted of a capital
|
0022| felony, he shall be punished by life imprisonment or death. The
|
0023| punishment shall be imposed after a sentencing hearing separate
|
0024| from the trial or guilty plea proceeding. However, if the
|
0025| defendant has not reached the age of majority at the time of the
|
0001| commission of the capital felony for which he was convicted, he
|
0002| may be sentenced to life imprisonment but shall not be punished
|
0003| by death.
|
0004| B. In the event the death penalty in a capital
|
0005| felony case is held to be unconstitutional or otherwise
|
0006| invalidated by the supreme court of the state of New Mexico or
|
0007| the supreme court of the United States, the person previously
|
0008| sentenced to death for a capital felony shall be sentenced to
|
0009| life imprisonment.
|
0010| C. A person who commits murder in the first degree
|
0011| while in the commission of any felony or while attempting to
|
0012| commit any felony as provided in Paragraph (2) of Subsection A
|
0013| of Section 30-2-1 NMSA 1978 may be charged with and convicted of
|
0014| both murder in the first degree and the underlying felony. The
|
0015| person may be sentenced to serve consecutive sentences for both
|
0016| murder in the first degree and the underlying felony."
|
0017| Section 2. EFFECTIVE DATE.--The effective date of the
|
0018| provisions of this act is July 1, 1996.
