0012| RELATING TO PUBLIC ASSISTANCE; PROVIDING A MORATORIUM ON

0013| REDUCTIONS IN PAYMENTS AND SERVICES; DECLARING AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. MORATORIUM ON REDUCTIONS IN PAYMENTS OR
|
0017| SERVICES IN CERTAIN PUBLIC ASSISTANCE PROGRAMS.--In any program
|
0018| of assistance or services administered by the human services
|
0019| department in which the budgeted expenditures for the program
|
0020| include amounts from general fund appropriations, the department
|
0021| shall not, during the period from the effective date of this
|
0022| section until October 1, 1997, reduce the level of assistance or
|
0023| services from the level existing on January 1, 1996, by:
|
0024| A. changing eligibility requirements to raise the
|
0025| threshold of eligibility for an individual or family to receive
|
0001| assistance or services; or
|
0002| B. decreasing the amount of assistance or services
|
0003| that an individual or family may receive by changing standards
|
0004| of need, method of payment or reimbursement or similar changes. Section 2. EMERGENCY.--It is necessary for the public
|
0005| peace, health and safety that this act take effect immediately.
