0012| RELATING TO ELECTIONS; CLARIFYING THAT A CANDIDATE FOR A COUNTY

0013| OFFICE IS NOT REQUIRED TO FILE A NOMINATING PETITION; AMENDING A
|
0014| SECTION OF THE ELECTION CODE; DECLARING AN EMERGENCY.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 1-8-21 NMSA 1978 (being Laws 1994,
|
0018| Chapter 92, Section 2, as amended) is amended to read:
|
0019| "1-8-21. PRIMARY ELECTION--METHODS OF PLACING NAMES ON
|
0020| PRIMARY BALLOT.--
|
0021| A. [All candidates] A candidate seeking primary
|
0022| election nomination to a statewide office or the office of
|
0023| United States representative shall file [declarations] a
|
0024| declaration of candidacy with the proper filing officer.
|
0025| [Candidates] A candidate shall file a nominating
|
0001| [petitions] petition at the time of filing [their
|
0002| declarations] the declaration of candidacy. [Candidates]
|
0003| A candidate who [seek] seeks, but [do] does not
|
0004| obtain, preprimary convention designation by a major political
|
0005| party may file a new [declarations] declaration of
|
0006| candidacy and a nominating [petitions] petition pursuant
|
0007| to Section 1-8-33 NMSA 1978.
|
0008| B. [Candidates] A candidate for [any other
|
0009| office] a legislative office, the office of district attorney,
|
0010| district judge, metropolitan judge, magistrate judge or the
|
0011| state board of education shall have [their names] his name
|
0012| placed on the primary election ballot by filing [declarations]
|
0013| with the proper filing officer a declaration of candidacy and
|
0014| a nominating [petitions with the proper filing officer.
|
0015| Candidates for county office shall also pay filing fees or file
|
0016| the proper paupers' statements at the time of filing
|
0017| declarations of candidacy] petition.
|
0018| C. A candidate for a county office shall have his
|
0019| name placed on the primary election ballot by filing with the
|
0020| proper filing officer a declaration of candidacy accompanied by
|
0021| the appropriate filing fee or a pauper's statement."
|
0022| Section 2. EMERGENCY.--It is necessary for the public
|
0023| peace, health and safety that this act take effect immediately.

0006| Section 2 is repealed effective January 1, 1997.

0008| Section 3. Effective January 1, 1997, a new Section 1-8-21 NMSA

0009| 1978 is enacted to read:
