0012| RELATING TO CRIMINAL LAW; INCREASING THE CRIMINAL PENALTIES FOR

0013| INDECENT EXPOSURE; CREATING A NEW CRIMINAL OFFENSE KNOWN AS
|
0014| AGGRAVATED INDECENT EXPOSURE; AMENDING AND ENACTING SECTIONS OF
|
0015| THE CRIMINAL CODE.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 30-9-14 NMSA 1978 (being Laws 1975,
|
0019| Chapter 109, Section 5) is amended to read:
|
0020| "30-9-14. INDECENT EXPOSURE.--
|
0021| A. Indecent exposure consists of a person
|
0022| knowingly and intentionally exposing his primary genital area to
|
0023| public view.
|
0024| B. As used in this section, "primary genital area"
|
0025| means the mons pubis, penis, testicles, mons veneris, vulva or
|
0001| vagina.
|
0002| [Whoever commits indecent exposure before a child under
|
0003| the age of thirteen is guilty of a misdemeanor.
|
0004| Whoever commits indecent exposure before a person thirteen
|
0005| years of age or older is guilty of a petty misdemeanor.]
|
0006| C. Whoever commits indecent exposure before a child
|
0007| under the age of eighteen is guilty of a fourth degree felony.
|
0008| D. Whoever commits indecent exposure before a
|
0009| person eighteen years of age or older is guilty of a
|
0010| misdemeanor. Upon a second or subsequent conviction for
|
0011| committing indecent exposure before a person eighteen years of
|
0012| age or older, the offender is guilty of a fourth degree
|
0013| felony."
|
0014| Section 2. A new section of the Criminal Code is enacted
|
0015| to read:
|
0016| "[NEW MATERIAL] AGGRAVATED INDECENT EXPOSURE.--
|
0017| A. Aggravated indecent exposure consists of a person
|
0018| knowingly and intentionally exposing his primary genital area to
|
0019| public view while committing one or more of the following
|
0020| criminal offenses:
|
0021| (1) assault, as provided in Section 30-3-1 NMSA
|
0022| 1978;
|
0023| (2) aggravated assault, as provided in Section
|
0024| 30-3-2 NMSA 1978;
|
0025| (3) assault with intent to commit a violent
|
0001| felony, as provided in Section 30-3-3 NMSA 1978;
|
0002| (4) battery, as provided in Section 30-3-4 NMSA
|
0003| 1978; or
|
0004| (5) aggravated battery, as provided in Section
|
0005| 30-3-5 NMSA 1978.
|
0006| B. As used in this section, "primary genital area"
|
0007| means the mons pubis, penis, testicles, mons veneris, vulva or
|
0008| vagina.
|
0009| C. Whoever commits aggravated indecent exposure
|
0010| before a child under the age of eighteen is guilty of a third
|
0011| degree felony.
|
0012| D. Whoever commits aggravated indecent exposure
|
0013| before a person eighteen years of age or older is guilty of a
|
0014| fourth degree felony."
|
0015| Section 3. EFFECTIVE DATE.--The effective date of the
|
0016| provisions of this act is July 1, 1996.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|

0003| years of age or older is guilty of a petty misdemeanor.]

0004| D. In addition to any punishment provided pursuant to
|
0005| the provisions of this section, the court shall order a person
|
0006| convicted for committing indecent exposure to participate in and
|
0007| complete a program of professional counseling at his own
|
0008| expense."
|
0009| Section 2. A new section of the Criminal Code is enacted to

0010| read:

0011| "[NEW MATERIAL] AGGRAVATED INDECENT EXPOSURE.--

0012| A. Aggravated indecent exposure consists of a person
|
0013| knowingly and intentionally exposing his primary genital area to
|
0014| public view in a lewd and lascivious manner, with the intent to
|
0015| threaten or intimidate another person, while committing one or
|
0016| more of the following acts or criminal offenses:
|
0017| (1) exposure to a child less than eighteen years
|
0018| of age;
|
0019| (2) assault, as provided in Section 30-3-1 NMSA
|
0020| 1978;
|
0021| (3) aggravated assault, as provided in Section
|
0022| 30-3-2 NMSA 1978;
|
0023| (4) assault with intent to commit a violent
|
0024| felony, as provided in Section 30-3-3 NMSA 1978;
|
0025| (5) battery, as provided in Section 30-3-4 NMSA
|
0001| 1978;
|
0002| (6) aggravated battery, as provided in Section 30-3-5 NMSA 1978;
|
0003| (7) criminal sexual penetration, as provided in
|
0004| Section 30-9-11 NMSA 1978; or
|
0005| (8) abuse of a child, as provided in Section
|
0006| 30-6-1 NMSA 1978.
|
0007| B. As used in this section, "primary genital area" means
|
0008| the mons pubis, penis, testicles, mons veneris, vulva or vagina.
|
0009| C. Whoever commits aggravated indecent exposure is guilty
|
0010| of a fourth degree felony.
|
0011| D. In addition to any punishment provided pursuant to the
|
