0012|     RELATING TO PUBLIC ASSISTANCE; AMENDING SECTION 27-5-7 NMSA 1978

0013|     (BEING LAWS 1965, CHAPTER 234, SECTION 7, AS AMENDED) TO CHANGE
    |
0014|     THE PURPOSE FOR WHICH MONEY IN THE COUNTY INDIGENT HOSPITAL
    |
0015|     CLAIMS FUND CAN BE USED; MAKING AN APPROPRIATION; DECLARING AN
    |
0016|     EMERGENCY.

0018|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0019|       Section 1.  Section 27-5-7 NMSA 1978 (being Laws 1965,
    |
0020|     Chapter 234, Section 7, as amended) is amended to read:
    |
0021|       "27-5-7.  COUNTY INDIGENT HOSPITAL CLAIMS FUND.--
    |
0022|            A.  There is created in the county treasury of each
    |
0023|     county a "county indigent hospital claims fund".
    |
0024|            B.  Collections under the levy made pursuant to the
    |
0025|     Indigent Hospital and County Health Care Act and all payments
    |
0001|     shall be placed into the fund, and the amount placed in the fund
    |
0002|     shall be budgeted and expended <s>[only]</s> for the purposes
    |
0003|     specified in the Indigent Hospital and County Health Care Act
    |
0004|     <u>and for operations and making improvements to hospitals and
</u>    |
<u></u>0005| <u>    health care facilities licensed by the department of health in
</u>    |
<u></u>0006| <u>    class C counties with a total assessed valuation in 1993 of more
</u>    |
<u></u>0007| <u>    than sixty million dollars ($60,000,000) and class B counties
</u>    |
<u></u>0008| <u>    with a total assessed valuation in 1993 of more than three
</u>    |
<u></u>0009| <u>    hundred nineteen million two hundred fifty thousand dollars
</u>    |
<u></u>0010| <u>    ($319,250,000) but less than three hundred nineteen million
</u>    |
<u></u>0011| <u>    three hundred thousand dollars ($319,300,000).  Expenditures
</u>    |
<u></u>0012| <u>    from the fund shall be made</u> by warrant upon vouchers approved
    |
0013|     by a majority of the board and signed by the chairman of the
    |
0014|     board.  Payments for indigent hospitalizations shall not be made
    |
0015|     from any other county fund.
    |
0016|            C.  The fund shall be audited in the manner that
    |
0017|     other state and county funds are audited, and all records of
    |
0018|     payments and verified statements of qualification upon which
    |
0019|     payments were made from the fund shall be open to the public.
    |
0020|            D.  Any balance remaining in the fund at the end of
    |
0021|     the fiscal year pursuant to <s>[Subsections F and G]</s> <u>Subsection
</u>    |
<u></u>0022| <u>    F</u> of this section shall carry over into the ensuing year, and
    |
0023|     that balance shall be taken into consideration in the
    |
0024|     determination of the ensuing year's budget and certification of
    |
0025|     need for purposes of making a tax levy. 
    |
0001|            E.  Money may be transferred to the fund from other
    |
0002|     sources, but no transfers may be made from the fund for any
    |
0003|     purpose other than those specified in the Indigent Hospital and
    |
0004|     County Health Care Act.
    |
0005|            F.  On June 30 of each fiscal year, beginning in
    |
0006|     1996, the board shall <s>[tranfer]</s> <u>transfer</u> to the county-supported medicaid fund that amount of the balance in the county
    |
0007|     indigent hospital claims fund that exceeds two hundred thousand
    |
0008|     dollars ($200,000) or that exceeds the amount equal to thirty
    |
0009|     percent of the income to the fund during that fiscal year,
    |
0010|     whichever is greater.  Beginning in 1996, the transfer shall be
    |
0011|     made <s>[by]</s> <u>no later than</u> September 1 of each fiscal year. 
    |
0012|     Any amount transferred to the county-supported medicaid fund
    |
0013|     pursuant to this subsection is in addition to the county's
    |
0014|     obligation pursuant to Section 27-10-4 NMSA 1978."
    |
0015|       Section 2.  EMERGENCY.--It is necessary for the public
    |
0016|     peace, health and safety that this act take effect immediately.
