0012| RELATING TO MEDICAL INVESTIGATIONS; PROHIBITING THE STATE

0013| MEDICAL INVESTIGATOR FROM CHARGING FOR CERTAIN SERVICES
|
0014| PERFORMED FOR AN INDIAN NATION, TRIBE OR PUEBLO.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 24-11-3 NMSA 1978 (being Laws 1971,
|
0018| Chapter 112, Section 3, as amended) is amended to read:
|
0019| "24-11-3. STATE MEDICAL INVESTIGATOR--QUALIFICATIONS--DUTIES--OFFICE.--
|
0020| A. The state medical investigator shall be a
|
0021| physician licensed to practice in New Mexico. Insofar as
|
0022| practicable, the medical investigator shall be trained in the
|
0023| fields of pathology and forensic medicine.
|
0024| B. The state medical investigator shall maintain his
|
0025| office at the [school of medicine at the] university of New
|
0001| Mexico medical school.
|
0002| C. The state medical investigator shall appoint
|
0003| district medical investigators and, where necessary, deputy
|
0004| medical investigators who shall serve at his pleasure. The
|
0005| state medical investigator may assign deputy medical
|
0006| investigators to districts to work under the supervision of a
|
0007| district medical investigator. The district medical
|
0008| investigator shall be a licensed physician. When deemed
|
0009| necessary by the state medical investigator, he may direct a
|
0010| deputy or district medical [examiner] investigator to enter
|
0011| another district for the purpose of carrying out medical
|
0012| investigations.
|
0013| D. Any district created by the state medical
|
0014| investigator to be staffed by a district medical investigator
|
0015| shall be coextensive with one or more counties.
|
0016| E. The state medical investigator may enter into
|
0017| agreements for services to be performed by persons in the course
|
0018| of medical investigations.
|
0019| F. The state medical investigator shall, subject to
|
0020| the approval of the board of medical [investigations]
|
0021| investigators, promulgate rules and regulations for the proper
|
0022| investigation of deaths occurring within this state.
|
0023| G. The state medical investigator shall maintain
|
0024| records of the deaths occurring within this state which are
|
0025| investigated by either state or district medical investigators.
|
0001| H. In addition to other duties prescribed in this
|
0002| section, the state medical investigator shall also serve as the
|
0003| district medical investigator for Bernalillo county.
|
0004| I. Funds for the operation of the state and district
|
0005| medical investigators' offices shall be appropriated to and
|
0006| administered by the university of New Mexico medical school
|
0007| [of medicine].
|
0008| J. The state medical investigator may not charge
|
0009| for services performed for an Indian nation, tribe or pueblo if
|
0010| the state medical investigator performs the same services for an
|
0011| agency or political subdivision of the state without charge."
