0013| ASSISTANCE ACT TO EXCLUDE EARLY INTERVENTION PROGRAMS FOR

0014| DEVELOPMENTALLY DISABLED CHILDREN FROM THE MEDICAID MANAGED CARE

0015| PROGRAM.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 27-2-12.6 NMSA 1978 (being Laws 1994,
|
0019| Chapter 62, Section 22) is amended to read:
|
0020| "27-2-12.6. MEDICAID PAYMENTS--MANAGED CARE.--
|
0021| A. The department shall provide for a statewide,
|
0022| managed care system to provide cost-efficient, preventive,
|
0023| primary and acute care for medicaid recipients by July 1, 1995.
|
0024| B. The managed care system shall ensure:
|
0025| (1) access to medically necessary services,
|
0001| particularly for medicaid recipients with chronic health
|
0002| problems;
|
0003| (2) to the extent practicable, maintenance of
|
0004| the rural primary care delivery infrastructure;
|
0005| (3) that the department's approach is
|
0006| consistent with national and state health care reform
|
0007| principles; and
|
0008| (4) to the maximum extent possible, that
|
0009| medicaid-eligible individuals are not identified as such except
|
0010| as necessary for billing purposes.
|
0011| C. The department may exclude nursing homes,
|
0012| intermediate care facilities for the mentally retarded, medicaid
|
0013| in-home and community-based waiver services, [and] residential
|
0014| and community-based mental health services for children with
|
0015| serious emotional disorders and early intervention programs for
|
0016| developmentally disabled children or children at risk of
|
0017| developmental delay from the provisions of this section."
