0012| RELATING TO GOVERNMENTAL ETHICS; EXTENDING THE LIFE OF THE JOINT

0013| INTERIM GOVERNMENTAL ETHICS OVERSIGHT COMMITTEE; PROVIDING

0014| ADDITIONAL DUTIES FOR THE JOINT INTERIM GOVERNMENTAL ETHICS

0015| OVERSIGHT COMMITTEE.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 2-15-1 NMSA 1978 (being Laws 1993,
|
0019| Chapter 46, Section 46) is amended to read:
|
0020| "2-15-1. GOVERNMENTAL ETHICS OVERSIGHT COMMITTEE
|
0021| CREATED--TERMINATION.--The joint interim "governmental ethics
|
0022| oversight committee" is created. The committee shall function
|
0023| from the date of its appointment until the first day of December
|
0024| prior to the first session of the [forty-third] forty-fifth
|
0025| legislature."

0001| Section 2. Section 2-15-3 NMSA 1978 (being Laws 1993,
|
0002| Chapter 46, Section 48) is amended to read:
|
0003| "2-15-3. POWERS AND DUTIES.--
|
0004| A. After its appointment, the governmental ethics
|
0005| oversight committee shall hold one organizational meeting to
|
0006| develop a workplan and budget for the ensuing interim. The
|
0007| workplan and budget shall be submitted to the New Mexico
|
0008| legislative council for approval. Upon approval of the
|
0009| workplan and budget by the New Mexico legislative council, the
|
0010| committee shall:
|
0011| (1) examine the statutes, constitutional
|
0012| provisions and regulations governing governmental ethics in New
|
0013| Mexico;
|
0014| (2) monitor and oversee the implementation of
|
0015| the legislative directives pertaining to financial disclosure,
|
0016| campaign reporting, lobbyist regulation and governmental conduct
|
0017| and financial disclosure laws;
|
0018| (3) review issues related to statewide and
|
0019| legislative campaign expenditure and contribution limitations,
|
0020| public financing of political campaigns and other types of
|
0021| campaign finance reform, limitations on campaign periods,
|
0022| increased access for participants in the political process,
|
0023| ethical issues related to gaming, nepotism, legislative expense
|
0024| reimbursement and extension of campaign reporting requirements
|
0025| to various political subdivisions of the state; and
|
0001| (4) make recommendations relating to the
|
0002| adoption of rules and legislation, if any are found to be
|
0003| necessary.

0004| B. The committee shall regularly receive testimony
|
0005| from the secretary of state and the attorney general relating to
|
0006| the implementation of the legislative directives and shall
|
0007| review any proposed rules, regulations or reporting forms prior
|
0008| to adoption."
