0014| SERVICES DEPARTMENT TO NEGOTIATE A RATE OF REIMBURSEMENT FOR

0015| SERVICES PERFORMED BY MEDICAL PROVIDERS.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 27-2-12.3 NMSA 1978 (being Laws 1987,
|
0019| Chapter 269, Section 1) is amended to read:
|
0020| "27-2-12.3. MEDICAID REIMBURSEMENT--EQUAL PAY FOR EQUAL
|
0021| PHYSICIANS', DENTISTS', OPTOMETRISTS', PODIATRISTS' AND
|
0022| PSYCHOLOGISTS' SERVICES.--The human services department shall
|
0023| establish a rate for the reimbursement of physicians, dentists,
|
0024| optometrists, podiatrists and psychologists for services
|
0025| rendered to medicaid patients that provides equal reimbursement
|
0001| for the same or similar services rendered without respect to the
|
0002| date on which such physician, dentist, optometrist, podiatrist
|
0003| or psychologist entered into practice in New Mexico, the date on
|
0004| which the physician, dentist, optometrist, podiatrist or
|
0005| psychologist entered into an agreement or contract to provide
|
0006| such services or the location in which such services are to be
|
0007| provided in the state; provided, however, that the requirements
|
0008| of this section shall not apply when the human services
|
0009| department contracts with entities pursuant to Section 27-2-12.6
|
0010| NMSA 1978 to negotiate a rate for the reimbursement for services
|
0011| rendered to medicaid patients in the medicaid managed care
|
0012| system."
