0012| RELATING TO OBSOLETE PROPERTY; AMENDING A SECTION OF THE
|
0013| PROCUREMENT CODE; DECLARING AN EMERGENCY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 13-6-1 NMSA 1978 (being Laws 1961,
|
0017| Chapter 100, Section 1, as amended) is amended to read:
|
0018| "13-6-1. DISPOSITION OF OBSOLETE, WORN-OUT AND UNUSABLE
|
0019| PERSONAL PROPERTY.--
|
0020| A. The governing authority of each state agency,
|
0021| local public body, school district and state educational
|
0022| institution may dispose of any item of personal property
|
0023| belonging to that authority and delete the item from its public
|
0024| inventory upon a specific finding by the authority that the item
|
0025| of property is:
|
0001| (1) of a current resale value of five thousand
|
0002| dollars ($5,000) or less; and
|
0003| (2) worn-out, unusable or obsolete to the
|
0004| extent that the item is no longer economical or safe for
|
0005| continued use by the body.
|
0006| B. The governing authority shall, as a prerequisite
|
0007| to the disposition of any items of personal property, give
|
0008| notification at least thirty days prior to its action making
|
0009| such deletion by sending a copy of its official finding and the
|
0010| proposed disposition of the property to the state auditor, duly
|
0011| sworn and subscribed under oath by each member of the authority
|
0012| approving the action.
|
0013| C. A copy of the official finding and proposed
|
0014| disposition of the property sought to be disposed of shall be
|
0015| made a permanent part of the official minutes of the governing
|
0016| authority.
|
0017| D. The governing authority shall dispose of the item
|
0018| by negotiated sale or donation to other state agencies, local
|
0019| public bodies, school districts, state educational institutions
|
0020| [or], municipalities or any governmental unit of an Indian
|
0021| nation, tribe or pueblo located in New Mexico or through the
|
0022| central purchasing office by means of competitive sealed bid or
|
0023| public auction or through the federal property assistance bureau
|
0024| of the general services department.
|
0025| E. This section shall not apply to any property
|
0001| acquired by a museum through abandonment procedures pursuant to
|
0002| the Abandoned Cultural Properties Act."
|
0003| Section 2. EMERGENCY.--It is necessary for the public
|
0004| peace, health and safety that this act take effect immediately.
