Section 22-25-9 NMSA 1978 (being Laws 1975 | 0017| (S.S.), Chapter 5, Section 9, as amended by Laws 1988, Chapter | 0018| 64, Section 44 and also by Laws 1988, Chapter 66, Section 2) is | 0019| amended to read: | 0020| "22-25-9. STATE DISTRIBUTION TO DISTRICT IMPOSING TAX | 0021| UNDER CERTAIN CIRCUMSTANCES.--The [director] state | 0022| superintendent shall distribute to any school district that has | 0023| imposed a tax under the Public School Capital Improvements Act | 0024| an amount from the public school capital improvements fund that | 0025| is equal to the amount by which the revenue estimated to be | 0001| received from the imposed tax, at the rate certified by the | 0002| department of finance and administration in accordance with | 0003| Section 22-25-7 NMSA 1978, assuming a one hundred percent | 0004| collection rate, is less than an amount calculated by | 0005| multiplying the district's first forty-days' total program units | 0006| times [thirty-five dollars ($35.00)] forty dollars ($40.00) | 0007| and further multiplying the product obtained by the tax rate | 0008| approved by the qualified electors in the most recent election | 0009| on the question of imposing a tax under the Public School | 0010| Capital Improvements Act. The distribution shall be made each | 0011| year that the tax is imposed in accordance with Section 22-25-7 | 0012| NMSA 1978; provided that no state distribution from the public | 0013| school capital improvements fund may be used for capital | 0014| improvements to any administration building of a school | 0015| district. In the event that sufficient funds are not available | 0016| in the public school capital improvements fund to make the state | 0017| distribution provided for in this section, the dollar per | 0018| program unit figure shall be reduced as necessary." | 0019| Section 2. APPROPRIATION.--Three million three hundred | 0020| sixty-one thousand dollars ($3,361,000) is appropriated from the | 0021| general fund to the public school capital improvements fund for | 0022| expenditure in fiscal year 1997 for the purpose of making | 0023| distributions to local school districts pursuant to the Public | 0024| School Capital Improvements Act.
