0012| RELATING TO PUBLIC SCHOOL TRANSPORTATION; AUTHORIZING THE USE OF
|
0013| CERTAIN TRANSPORTATION FUNDS FOR OTHER TRANSPORTATION-RELATED
|
0014| SERVICES.
|

|
0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 22-8-26 NMSA 1978 (being Laws 1967,
|
0018| Chapter 16, Section 76, as amended) is amended to read:
|
0019| "22-8-26. TRANSPORTATION DISTRIBUTION.--
|
0020| A. Money in the transportation distribution of the
|
0021| public school fund shall be used only for the purpose of making
|
0022| payments to each school district for the to and from school
|
0023| transportation costs of students in grades kindergarten through
|
0024| twelve attending public school within the school district and of
|
0025| three- and four-year-old children who meet the state board
|
0001| approved criteria and definition of developmentally disabled and
|
0002| for transportation of students to and from their regular
|
0003| attendance centers and the place where vocational education
|
0004| programs are being offered.
|
0005| B. In the event a school district's transportation
|
0006| allocation exceeds the amount required to meet obligations to
|
0007| provide to and from transportation, three- and four-year-old
|
0008| developmentally disabled transportation and vocation education
|
0009| transportation, the district shall [revert] use the
|
0010| remaining transportation funds [to the transportation
|
0011| distribution in the department] for other transportation-related services. The district shall submit a report to the
|
0012| department of education regarding expenditures for other
|
0013| transportation-related services, pursuant to Section 22-8-29
|
0014| NMSA 1978.
|
0015| C. In the event the sum of the proposed
|
0016| transportation allocations to each school district exceeds the
|
0017| amounts in the transportation distribution, the allocation to
|
0018| each school district shall be reduced in the proportion that the
|
0019| local school district allocation bears to the total statewide
|
0020| transportation distribution.
|
0021| D. Local school boards, with the approval of the
|
0022| state transportation director, may provide additional
|
0023| transportation services pursuant to Section 22-16-2 NMSA 1978 to
|
0024| meet established program needs."
|
0025| Section 2. Section 22-8-29 NMSA 1978 (being Laws 1967,
|
0001| Chapter 16, Section 78, as amended) is amended to read:
|
0002| "22-8-29. TRANSPORTATION DISTRIBUTIONS--REPORTS--PAYMENTS.--
|
0003| A. Prior to November 15 of each year, each local
|
0004| school board of a school district shall report to the state
|
0005| transportation director, upon forms furnished by the state
|
0006| transportation director, the following information concerning
|
0007| the district's operation on the fortieth day of school:
|
0008| (1) the number and designation of school bus
|
0009| routes in operation in the school district;
|
0010| (2) the number of miles traveled by each school
|
0011| bus on each school bus route, showing the route mileage in
|
0012| accordance with the type of road surface traveled;
|
0013| (3) the number of students transported on the
|
0014| fortieth day of school;
|
0015| (4) the projected number of students to be
|
0016| transported in the next school year;
|
0017| (5) the percentage of unpaved or unimproved
|
0018| roads [utilized] used by school buses in the school
|
0019| district; [and]
|
0020| (6) the seating capacity, age and mileage of
|
0021| each bus [utilized] used in the district for student
|
0022| transportation; and
|
0023| (7) prior year expenditures for other
|
0024| transportation-related services made from remaining
|
0025| transportation funds.
|
0001| B. Each local school board of a school district
|
0002| maintaining a school bus route shall make further reports to the
|
0003| state transportation director at other times specified by the
|
0004| state transportation director.
|
0005| C. The state transportation director shall certify
|
0006| to the state superintendent that the allocations from the
|
0007| transportation distributions to each school district are based
|
0008| upon the transportation distribution formula established in the
|
0009| Public School Code. The allocations for the first six months of
|
0010| a school year shall be based upon the tentative transportation
|
0011| budget of the school district for the current fiscal year.
|
0012| Allocations to a school district for the remainder of the school
|
0013| year shall adjust the amount received by the school district so
|
0014| that it equals the amount the school district is entitled to
|
0015| receive for the entire school year based upon the November 15
|
0016| report and subject to audit and verification.
|
0017| D. The department shall make periodic installment
|
0018| payments to school districts during the school year from the
|
0019| transportation distributions, based upon the allocations
|
0020| certified by the state transportation director."
|
0021| Section 3. EFFECTIVE DATE.--The effective date of the
|
0022| provisions of this act is July 1, 1996.
