Section 9-16-14 NMSA 1978 (being Laws 1987, | 0019| Chapter 298, Section 1, as amended) is amended to read: | 0020| "9-16-14. REGULATION AND LICENSING DEPARTMENT OPERATING | 0021| FUND.-- | 0022| A. There is established in the state treasury the | 0023| "regulation and licensing department operating fund" to be | 0024| administered by the department. | 0025| B. All money received by the administrative services | 0001| division [the construction industries division], the financial | 0002| institutions division, the securities division and the | 0003| manufactured housing division, other than money earmarked for | 0004| revolving funds, shall be deposited with the state treasurer and | 0005| held in a separate suspense account for each division. [In the | 0006| seventy-sixth fiscal year, all money deposited in the suspense | 0007| accounts shall be transferred monthly to the general fund until | 0008| the sum of all money transferred to the general fund equals the | 0009| total amount deposited and transferred to the general fund from | 0010| those divisions in the seventy-fourth fiscal year. All | 0011| additional money deposited in the divisions' suspense accounts | 0012| during the seventy-sixth fiscal year shall be transferred to the | 0013| regulation and licensing department operating fund on June 30, | 0014| 1988] | 0015| C. [In the seventy-seventh fiscal year and each | 0016| fiscal year thereafter] On the last day of each month, the | 0017| department shall transfer all money received during the month | 0018| from the divisions' suspense accounts specified in Subsection B | 0019| of this section to the general fund." | 0020| Section 2. Section 60-13-21 NMSA 1978 (being Laws 1967, | 0021| Chapter 199, Section 24, as amended) is amended to read: | 0022| "60-13-21. DIVISION AND COMMISSION--DISPOSITION OF FEES | 0023| AND ADMINISTRATIVE PENALTIES--FUND CREATED--APPROPRIATION.--The "construction industries division operating fund" is | 0024| created. Fees received by the division [except journeymen | 0025| examination fees, shall be paid to the state treasurer for | 0001| deposit and transfer as provided in Section 9-16-14 NMSA 1978] | 0002| and administrative penalties imposed by the commission shall be | 0003| deposited with the state treasurer to be credited to the fund. | 0004| Balances in the fund shall not revert. Money in the fund is | 0005| appropriated to the division. Expenditures from the fund may be | 0006| made only in accordance with budgets approved by the department | 0007| of finance and administration and only to pay for the | 0008| administration of and to carry out the purposes of the | 0009| Construction Industries Licensing Act." | 0010| Section 3. REPEAL.--Section 60-13-40.1 NMSA 1978 (being | 0011| Laws 1983, Chapter 82, Section 2, as amended) is repealed. | 0012| Section 4.
