0020| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0021| Section 1. SHORT TITLE.--This act may be cited as the
|
0022| "Information and Communication Management Act".
|
0023| Section 2. PURPOSE OF ACT.--The purpose of the Information
|
0024| and Communication Management Act is to create a central resource
|
0025| for strategic information and communications systems planning
|
0001| for state government to:
|
0002| A. assist executive agencies in establishing and
|
0003| maintaining efficient and cost-effective information management
|
0004| and communications systems, appropriate to the missions of the
|
0005| agencies that will enable the agencies to more effectively carry
|
0006| out their responsibilities to the public;
|
0007| B. provide leadership in developing and revising the
|
0008| statewide information architecture through collaboration with
|
0009| state executive agencies; and
|
0010| C. provide a centralized source for the
|
0011| administration of the information architecture and other
|
0012| statewide policies on information technology.
|
0013| Section 3. DEFINITIONS.--As used in the Information and
|
0014| Communication Management Act:
|
0015| A. "executive agency" means a state agency,
|
0016| instrumentality, board or commission in the executive branch of
|
0017| state government, state educational institutions and local
|
0018| political subdivisions;
|
0019| B. "information and communications systems" means
|
0020| computer, voice and data communications software and hardware,
|
0021| including imaging systems, terminals, radio and communications
|
0022| networks and facilities; and
|
0023| C. "information architecture" means documents of
|
0024| statewide application that contain principles, policies,
|
0025| standards and guidelines for development of information and
|
0001| communications systems for state agencies.
|
0002| Section 4. OFFICE ON INFORMATION AND COMMUNICATION
|
0003| MANAGEMENT CREATED--ADMINISTRATIVE ATTACHMENT--CHIEF INFORMATION
|
0004| OFFICER--QUALIFICATIONS--STAFF.--
|
0005| A. The "office on information and communication
|
0006| management" is created. The office is administratively attached
|
0007| to the office of the governor.
|
0008| B. The administrative head of the office on
|
0009| information and communication management is the "chief
|
0010| information officer", who shall have a minimum of five years'
|
0011| experience in management of a large information technology
|
0012| system and shall be appointed by the governor. The chief
|
0013| information officer shall serve at the pleasure of the governor.
|
0014| C. The chief information officer shall have all the
|
0015| powers and duties of the office in the interim period between
|
0016| the time he is appointed by the governor and confirmation by the
|
0017| senate.
|
0018| D. The chief information officer is authorized to
|
0019| hire information and communications management analysts and
|
0020| other staff as necessary pursuant to the Personnel Act.
|
0021| Section 5. CHIEF INFORMATION OFFICER--DUTIES.--The chief
|
0022| information officer shall:
|
0023| A. collaborate with executive agencies, the
|
0024| technical advisory committee and other public entities to
|
0025| continue development of the existing information architecture;
|
0001| B. position the state to optimize the use of
|
0002| communications and information technology by ensuring through
|
0003| the information architecture that:
|
0004| (1) resources are used efficiently, redundancy
|
0005| is minimized and information systems support the requirements of
|
0006| state government as a whole and the missions of individual
|
0007| executive agencies;
|
0008| (2) efficient and judicious incorporation of
|
0009| information and communications technology innovations supports
|
0010| executive agency operations to control expenses, increase
|
0011| productivity, improve service and improve management controls;
|
0012| and
|
0013| (3) prudent risk management practices preserve
|
0014| the integrity and security of information and communications
|
0015| systems and ensure timely resumption of operations following a
|
0016| disaster;
|
0017| C. facilitate, cooperate with and provide guidance
|
0018| to executive agencies in the preparation of annual information
|
0019| and communications systems management plans, which shall include
|
0020| information about planned information technology objectives and
|
0021| expenditures for the next fiscal year in the level of detail and
|
0022| format specified by the chief information officer;
|
0023| D. work with the technical advisory committee and
|
0024| executive agencies to develop agency plans that:
|
0025| (1) demonstrate that the agency has developed
|
0001| relevant, achievable measurable objectives consistent with the
|
0002| agency's mission and existing statewide information and
|
0003| communications policies and goals, including the information
|
0004| architecture, or that departures from such policies and goals
|
0005| are justified;
|
0006| (2) show effective and efficient use of
|
0007| available resources, including staff, funds and existing capital
|
0008| and time;
|
0009| (3) specifically identify communities of
|
0010| interest, within and outside the agency, with whom information
|
0011| and data should be shared to prevent duplication of effort; and
|
0012| (4) provide for security of data and disaster
|
0013| recovery in a manner consistent with the agency's needs and
|
0014| statewide policies;
|
0015| E. make recommendations to the department of finance
|
0016| and administration and the legislative finance committee for
|
0017| approval or disapproval of executive agency requests for
|
0018| expenditures for information or communications management
|
0019| systems if requested information appropriations in any fiscal
|
0020| year exceed five hundred thousand dollars ($500,000). The
|
0021| amount requested is to be determined by calculation of amounts
|
0022| to be expended for equipment, software, maintenance costs,
|
0023| agreements for services and other related costs of such systems;
|
0024| F. monitor periodically the performance of executive
|
0025| agencies in achieving the goals of their individual plans and in
|
0001| achieving compliance with the information architecture. A
|
0002| written report shall be sent to the head of the agency and to
|
0003| the council on information. The report shall:
|
0004| (1) specify any noncompliance;
|
0005| (2) specify how the noncompliance can be
|
0006| rectified; and
|
0007| (3) give the executive agency the option to
|
0008| provide additional information relating to the noncompliance.
|
0009| The agency may respond in writing to the report within thirty
|
0010| days of receipt of the report. The response shall be forwarded
|
0011| with the report of the chief information officer to the
|
0012| department of finance and administration and the legislative
|
0013| finance committee;
|
0014| G. advise the department of finance and
|
0015| administration and the legislative finance committee if the
|
0016| chief information officer and the agency cannot reach agreement
|
0017| on a plan, by providing in writing an explanation of the areas
|
0018| of disagreement;
|
0019| H. facilitate the implementation of agency plans;
|
0020| I. review all budget requests for appropriations for
|
0021| information and communications systems for all executive
|
0022| agencies for each fiscal year. The chief information officer
|
0023| shall designate the priority of each requested expenditure by
|
0024| assigning priorities based on the state strategic plan for
|
0025| information and communications systems management. The priority
|
0001| listing shall be provided to the department of finance and
|
0002| administration and the legislative finance committee. Each
|
0003| agency shall also receive a copy of the priority listing. The
|
0004| budget request for appropriations shall be prepared in
|
0005| cooperation with each executive agency;
|
0006| J. appoint members of the technical advisory
|
0007| committee, call meetings of the committee and preside over the
|
0008| meetings, as provided in Section 7 of the Information and
|
0009| Communication Management Act; and
|
0010| K. update on an annual basis the state strategic
|
0011| plan for information and communications systems management.
|
0012| Amendments to the plan shall be made in cooperation with
|
0013| executive agencies and the technical advisory committee. The
|
0014| plan shall take into account the existing agency plans and the
|
0015| information architecture and assess the resources available,
|
0016| costs and benefits of provisions in the plan, including
|
0017| assessment of alternative courses of action, the risks involved,
|
0018| a summary of the state's current and projected use of
|
0019| information technology, a description of major changes in state
|
0020| policy and a brief description of each executive agency plan.
|
0021| Section 6. CHIEF INFORMATION OFFICER--POWERS.--The chief
|
0022| information officer shall have the power to:
|
0023| A. employ staff pursuant to the Personnel Act;
|
0024| B. obtain information, documents and records from
|
0025| each of the executive agencies as needed to carry out his
|
0001| duties;
|
0002| C. develop with state agencies annual information
|
0003| and communications systems management plans and, in the event of
|
0004| disagreement, report the areas of concern to the technical
|
0005| advisory committee;
|
0006| D. notify each executive agency, where necessary, of
|
0007| any noncompliance with statewide policies, including the
|
0008| information architecture or the agency's plan; and
|
0009| E. enter into contracts and agreements relating to
|
0010| any powers or duties given the chief information officer under
|
0011| the Information and Communication Management Act.
|
0012| Section 7. TECHNICAL ADVISORY COMMITTEE--CREATION--PURPOSE.--
|
0013| A. The "technical advisory committee" is created.
|
0014| The committee shall consist of senior technical representatives
|
0015| from the judiciary, the legislature, executive agencies, local
|
0016| political subdivisions, public school systems, higher education,
|
0017| the business community, the national laboratories and the
|
0018| general public and shall be appointed by the chief information
|
0019| officer. Meetings shall be held on the call of the chief
|
0020| information officer.
|
0021| B. The technical advisory committee shall represent
|
0022| users of the information and communications systems affected by
|
0023| the information architecture and shall provide advice to the
|
0024| chief information officer as to their needs.
|
0025| Section 8. EXECUTIVE AGENCY COOPERATION WITH CHIEF
|
0001| INFORMATION OFFICER.--
|
0002| A. Each executive agency of the state shall furnish
|
0003| and make available, upon request by the chief information
|
0004| officer or the technical advisory committee, documents,
|
0005| materials or information, not made confidential by law, related
|
0006| to its information or communications systems.
|
0007| B. Each executive agency shall present all requests
|
0008| for expenditures for information and communications systems for
|
0009| the subsequent fiscal year to the chief information officer by
|
0010| September 1 of the previous fiscal year. The executive agency
|
0011| shall assign a priority to each proposed expenditure.
|
0012| C. Each executive agency shall maintain and update,
|
0013| on an annual basis, an information and communication systems
|
0014| management plan pursuant to Sections 5 and 6 of the Information
|
0015| and Communication Management Act. The plan shall be developed
|
0016| in cooperation with the chief information officer by May 1 of
|
0017| each year for the fiscal beginning July 1 to reflect amounts
|
0018| budgeted. All departures from the information architecture or
|
0019| other statewide policies shall be justified by the agency
|
0020| submitting the plan. A copy of the final plan for the agency
|
0021| shall be given by the chief information officer, the head of the
|
0022| agency, the department of finance and administration and the
|
0023| legislative finance committee. All expenditures for any
|
0024| information or communications management systems that exceed
|
0025| five hundred thousand dollars ($500,000) in any fiscal year
|
0001| shall be specifically identified. No expenditure may be made
|
0002| for such systems until the plan is approved by the chief
|
0003| information officer.
|
0004| D. Each executive agency shall appoint a person or
|
0005| group of persons with the necessary technical expertise for the
|
0006| purpose of providing a continuing liaison with the office on
|
0007| information and communication management.
|
0008| Section 9. SUCCESSOR TO THE COMMISSION ON INFORMATION
|
0009| MANAGEMENT.--On the effective date of the provisions of the
|
0010| Information and Communication Management Act, the office of
|
0011| communication and information management shall succeed to all
|
0012| rights and responsibilities of the commission on information and
|
0013| communication management, including all contractual and property
|
0014| rights and obligations. On the effective date, all references
|
0015| in the law to the commission on information and communication
|
0016| management shall be deemed to be references to the office of
|
0017| communication and information management.
|
0018| Section 10. TEMPORARY PROVISION--TRANSFER OF PERSONNEL AND
|
0019| PROPERTY.--On the effective date of the provisions of the
|
0020| Information and Communication Management Act, all employees,
|
0021| budgets, appropriations, property, facilities, equipment,
|
0022| supplies and records of the commission on information and
|
0023| communication management are transferred to the office on
|
0024| information and communication management.
|
0025| Section 11. SUNSET--TERMINATION OF OFFICE ON TECHNOLOGY
|
0001| AND COMMUNICATION MANAGEMENT.--The office on information and
|
0002| communication management is terminated on July 1, 1998 pursuant
|
0003| to the Sunset Act. Effective July 1, 1998, the Information and
|
0004| Communication Management Act is repealed.
|
0005| Section 12. EFFECTIVE DATE.--The effective date of the
|
0006| provisions of this act is July 1, 1996.

0001| compliance with those policies, procedures and standards;
|
0002| C. ensure that prudent risk management practices
|
0003| preserve the integrity and security of information and
|
0004| communications systems and ensure timely resumption of operations
|
0005| following a disaster;
|
0006| D. facilitate, cooperate with and provide guidance to
|
0007| executive agencies in the preparation of annual information and
|
0008| communications systems management plans, which shall include
|
0009| information about planned information technology objectives and
|
0010| expenditures for the next fiscal year in the level of detail and

|
0011| maintenance costs, agreements for services and other related costs
|
0012| of such systems;
|
0013| G. monitor periodically the performance of executive
|
0014| agencies in achieving the goals of their individual plans and in
|
0015| achieving compliance with the information architecture. A written
|
0016| report shall be sent to the head of the agency. The report shall:
|
0017| (1) specify compliance with information
|
0018| architecture;
|

0020| (3) specify solutions for improved compliance;
|
0021| and
|
0022| (4) be provided, along with agency
|
0023| recommendations, to the legislative finance committee;

0024| H. develop a schedule for ongoing monitoring of major
|
0025| system development projects. A written report shall be sent to the
|
0001| head of the agency as specified in the schedule. The report shall:
|
0002| (1) specify compliance with information
|
0003| architecture;
|
0004| (2) specify compliance with audit
|
0005| guidelines;
|
0006| (3) provide recommendations for improved
|
0007| compliance; and
|
0008| (4) be provided, along with agency
|
0009| recommendations, to the legislative finance committee;
|
0010| I. review all budget requests for appropriations for
|
0011| information and communications systems for all executive agencies
|
0012| for each fiscal year. The chief information officer shall
|
0013| designate the priority of each requested expenditure by assigning
|
0014| priorities based on the state strategic plan for information and
|
0015| communications systems management. The priority listing shall be
|
0016| provided to the department of finance and administration and the
|
0017| legislative finance committee. Each agency shall also receive a

0001| communications systems management on a continual basis. The plan
|
0002| shall be submitted annually to the department of finance and
|
0003| administration. Amendments to the plan shall be made in
|
0004| cooperation with executive agencies and the technical advisory
|
0005| committee. The plan shall take into account the existing agency
|
0006| plans and the information architecture and assess the resources
|
0007| available, costs and benefits of provisions in the plan, including
|
0008| assessment of alternative courses of action, the risks involved, a
|
0009| summary of the state's current and projected use of information
|
0010| technology, a description of major changes in state policy and a
|
0011| brief description of each executive agency plan.
|

0025| F. approve as a signatory professional service
|
0001| contracts for information and communication systems; and
|
0002| G. approve rate structures for the information systems
|
0003| division of the general services department.
|
0004| Section 7. TECHNICAL ADVISORY COMMITTEE--CREATION--PURPOSE.--
|
0005| A. The "technical advisory committee" is created. The

0006| committee shall consist of senior technical representatives from
|
0007| the judiciary, the legislature, executive agencies, local political
|
0008| subdivisions, public school systems, higher education, the business
|
0009| community, the national laboratories and the general public and
|
0010| shall be appointed by the chief information officer. Meetings
|
0011| shall be held on the call of the chief information officer.
|
0012| B. The technical advisory committee shall represent
|
0013| users of the information and communications systems affected by the
|
0014| information architecture and shall provide advice to the chief
|
0015| information officer as to their needs.
|
0016| Section 8. EXECUTIVE AGENCY COOPERATION WITH CHIEF
|
0017| INFORMATION OFFICER.--
|
0018| A. Each executive agency of the state shall furnish and
|
0019| make available, upon request by the chief information officer or
|
0020| the technical advisory committee, documents, materials or
|
0021| information, not made confidential by law, related to its
|
0022| information or communications systems.
|
0023| B. Each executive agency shall present all requests for
|
0024| expenditures for information and communications systems for the
|
0025| subsequent fiscal year to the chief information officer by
|
0001| September 1 of the previous fiscal year. The executive agency
|
0002| shall assign a priority to each proposed expenditure.
|
0003| C. Each executive agency shall maintain and update
|
0004| continually an information and communication systems management
|
0005| plan pursuant to Sections 5 and 6 of the Information and
|
0006| Communication Management Act. The plan shall be developed annually
|
0007| in cooperation with the chief information officer by May 1 of each
|
0008| year for the fiscal beginning July 1 to reflect amounts budgeted.
|
0009| All departures from the information architecture or other statewide
|
0010| policies shall be justified by the agency submitting the plan. A
|
0011| copy of the final plan for the agency shall be given by the chief
|
0012| information officer to the head of the agency, the department of
|
0013| finance and administration and the legislative finance committee.
|
0014| All expenditures for any information or communications management
|
0015| systems that exceed five hundred thousand dollars ($500,000) in any
|
0016| fiscal year shall be specifically identified. No expenditure may
|
0017| be made until the plan is approved by the chief information
|
0018| officer.
|
0019| D. Each executive agency shall appoint a person or
|
0020| group of persons with the necessary technical expertise for the
|
0021| purpose of providing a continuing liaison with the office on
|
0022| information and communication management.
|
0023| Section 9. SUCCESSOR TO THE COMMISSION ON INFORMATION
|
0024| MANAGEMENT.--On the effective date of the provisions of the
|
0025| Information and Communication Management Act, the office of
|
0001| communication and information management shall succeed to all
|
0002| rights and responsibilities of the commission on information and
|
0003| communication management, including all contractual and property
|
0004| rights and obligations. On the effective date, all references in
|
0005| the law to the commission on information and communication
|
0006| management shall be deemed to be references to the office of
|
0007| communication and information management.
|
0008| Section 10. TEMPORARY PROVISION--TRANSFER OF PERSONNEL AND
|
0009| PROPERTY.--On the effective date of the provisions of the
|
0010| Information and Communication Management Act, all employees,
|
0011| budgets, appropriations, property, facilities, equipment, supplies
|
0012| and records of the commission on information and communication
|
0013| management are transferred to the office on information and
|
0014| communication management.
|
0015| Section 11. SUNSET--TERMINATION OF OFFICE ON TECHNOLOGY AND
|
0016| COMMUNICATION MANAGEMENT.--The office on information and
|
0017| communication management is terminated on July 1, 1998 pursuant to
|
0018| the Sunset Act. Effective July 1, 1998, the Information and
|
0019| Communication Management Act is repealed.
|
0020| Section 12. EFFECTIVE DATE.--The effective date of the
|
0021| provisions of this act is July 1, 1996.
