0012| RELATING TO EDUCATION; CHANGING PROVISIONS OF THE TECHNOLOGY FOR

0013| EDUCATION ACT TO INCLUDE ACCREDITED PRIVATE SCHOOLS; AMENDING
|
0014| SECTIONS OF THE NMSA 1978.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 22-15A-4 NMSA 1978 (being Laws 1994,
|
0018| Chapter 96, Section 4) is amended to read:
|
0019| "22-15A-4. BUREAU DUTIES.--In accordance with the policies
|
0020| and regulations of the state board, the bureau shall:
|
0021| A. administer the provisions of the Technology for
|
0022| Education Act;
|
0023| B. develop a statewide plan for the integration of
|
0024| educational technology into the public schools and accredited
|
0025| private schools and coordinate technology-related education
|
0001| activities with other state agencies, the federal government,
|
0002| business consortia and public or private agencies or
|
0003| individuals;
|
0004| C. assist school districts to develop and implement
|
0005| a strategic, long-term plan for utilizing educational technology
|
0006| in the local school system;
|
0007| D. upon approval of a school district's technology
|
0008| plan, make distributions to school districts and accredited
|
0009| private schools from the educational technology fund;
|
0010| E. recommend funding mechanisms that will support
|
0011| the development and maintenance of an effective educational
|
0012| technology infrastructure in the state;
|
0013| F. promote collaboration among government, business,
|
0014| educational organizations and telecommunications entities to
|
0015| expand and improve the use of technology in education;
|
0016| G. assess and determine the educational technology
|
0017| needs of school districts and accredited private schools within
|
0018| the districts; and
|
0019| H. provide staff support for and coordinate the
|
0020| activities of the council."
|
0021| Section 2. Section 22-15A-5 NMSA 1978 (being Laws 1994,
|
0022| Chapter 96, Section 5) is amended to read:
|
0023| "22-15A-5. COUNCIL ON TECHNOLOGY IN EDUCATION--CREATED--PURPOSE.--The "council on technology in education" is created.
|
0024| The council shall advise the bureau, the state board and the
|
0025| legislature regarding the establishment of appropriate
|
0001| educational technology standards, technology-enhanced curricula,
|
0002| instruction, appropriations for educational technology and
|
0003| administrative resources and services for the public schools
|
0004| and accredited private schools."
|
0005| Section 3. Section 22-15A-6 NMSA 1978 (being Laws 1994,
|
0006| Chapter 96, Section 6) is amended to read:
|
0007| "22-15A-6. COUNCIL MEMBERSHIP.--
|
0008| A. The council shall be composed of seventeen
|
0009| members. Members shall be appointed by the state board for
|
0010| terms of four years. As designated by the state board at the
|
0011| time of initial appointment, the terms of five members shall
|
0012| expire at the end of two years, the terms of five members shall
|
0013| expire at the end of three years, and the terms of seven members
|
0014| shall expire at the end of four years.
|
0015| B. When appointing members, the state board shall
|
0016| appoint:
|
0017| (1) one member who shall have expertise in
|
0018| state government;
|
0019| (2) three members who shall have expertise in
|
0020| school district administration;
|
0021| (3) two members who shall have expertise in
|
0022| providing instructional services in post-secondary, technical-vocational or adult education;
|
0023| (4) three members who shall have expertise in
|
0024| providing instructional services in elementary or secondary
|
0025| schools, one of whom shall have expertise in the accredited
|
0001| private school sector;
|
0002| (5) two members who shall be parents of school-age children;
|
0003| (6) one member who shall be a public school
|
0004| secondary student;
|
0005| (7) three members who shall have expertise in
|
0006| educational technology; and
|
0007| (8) two members at large.
|
0008| C. In making appointments to the council, the state
|
0009| board shall give due consideration to gender and ethnicity to
|
0010| achieve a membership representative of the geographic and
|
0011| cultural diversity of New Mexico.
|
0012| D. Members of the council shall elect a chairman
|
0013| from among the membership. The council shall meet at the call
|
0014| of the chairman not less than quarterly.
|
0015| E. Members of the council shall receive per diem and
|
0016| mileage pursuant to the provisions of the Per Diem and Mileage
|
0017| Act, but shall receive no other compensation, perquisite or
|
0018| allowance."
|
0019| Section 4. Section 22-15A-7 NMSA 1978 (being Laws 1994,
|
0020| Chapter 96, Section 7) is amended to read:
|
0021| "22-15A-7. COUNCIL DUTIES.--The council shall:
|
0022| A. advise the bureau on implementation of the
|
0023| provisions of the Technology for Education Act;
|
0024| B. work with the bureau to conduct periodic
|
0025| assessments of the need for educational technology in the public
|
0001| school system and in accredited private schools and make
|
0002| recommendations to the state board on how to meet those needs;
|
0003| C. promote the collaborative development and
|
0004| implementation of educational technologies, projects and
|
0005| practices to enhance instruction capabilities;
|
0006| D. develop and recommend to the state board a
|
0007| statewide plan to infuse educational technology into the public
|
0008| school system and in accredited private schools in support of
|
0009| state and national education goals; and
|
0010| E. provide assistance to the bureau in review of
|
0011| school district technology plans."
|
0012| Section 5. Section 22-15A-9 NMSA 1978 (being Laws 1994,
|
0013| Chapter 96, Section 9) is amended to read:
|
0014| "22-15A-9. EDUCATIONAL TECHNOLOGY FUND--DISTRIBUTION.--
|
0015| A. Upon annual review and approval of a school
|
0016| district's educational technology plan, the bureau shall
|
0017| determine a separate distribution from the educational
|
0018| technology fund for each school district and accredited private
|
0019| schools in the district.
|
0020| B. On or before July 31 of each year, the bureau
|
0021| shall distribute money in the educational technology fund
|
0022| directly to each school district and accredited private school
|
0023| in the district in an amount equal to ninety percent of the
|
0024| district's estimated entitlement and each accredited private
|
0025| school's estimated entitlement as determined by the projected
|
0001| membership for the school year. A school district's entitlement
|
0002| and an accredited private school's entitlement is that portion
|
0003| of the total amount of the annual appropriation that the
|
0004| projected membership of the district or the accredited private
|
0005| school bears to the projected membership of the state.
|
0006| Kindergarten membership shall be calculated on a one-half
|
0007| full-time-equivalent basis.
|
0008| C. On or before January 30 of each year, the bureau
|
0009| shall recompute each entitlement using the final funded
|
0010| membership for school districts and forty-day membership for
|
0011| accredited private schools for that year and shall allocate the
|
0012| balance of the annual appropriation adjusting for any over- or
|
0013| under-projection of membership.
|
0014| D. Any school district or accredited private
|
0015| school receiving funding pursuant to the Technology for
|
0016| Education Act is responsible for the purchase, distribution, use
|
0017| and maintenance of educational technology.
|
0018| E. As used in this section, "membership" means the
|
0019| total school district enrollment of qualified students, as
|
0020| defined in the Public School Finance Act, or forty-day
|
0021| membership for accredited private schools on the current roll
|
0022| of class or school on a specified day. The current roll is
|
0023| established by the addition of original entries and re-entries
|
0024| minus withdrawals. Withdrawal of students, in addition to
|
0025| students formally withdrawn from the public school or
|
0001| accredited private school, includes students absent from the
|
0002| public school or accredited private school for as many as ten
|
0003| consecutive school days."
|
0004| Section 6. Section 22-15A-10 NMSA 1978 (being Laws 1994,
|
0005| Chapter 96, Section 10) is amended to read:
|
0006| "22-15A-10. ANNUAL REPORT.--Annually, at a time specified
|
0007| by the department of education, each local school district and
|
0008| each accredited private school receiving distributions from the
|
0009| educational technology fund shall file a report with the
|
0010| department of education regarding distributions received,
|
0011| expenditures made and educational technology obtained by the
|
0012| district and accredited private schools and such other related
|
0013| information as may be required by the department of education."
