0012| MAKING AN APPROPRIATION; TRANSFERRING FUNDS FROM THE FIRE

0013| PROTECTION FUND TO THE EMPLOYERS ACCUMULATION FUND AND MATCHING

0014| THE APPROPRIATION BY EMPLOYERS OR EMPLOYEES, OR BOTH, OF

0015| PARTICIPANTS IN THE MUNICIPAL FIRE MEMBER PLANS.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. APPROPRIATION.--
|
0019| A. Three hundred ninety thousand dollars ($390,000)
|
0020| is appropriated from the fire protection fund to the employers
|
0021| accumulation fund in the Public Employees Retirement Act for
|
0022| expenditure in fiscal year 1997 for the purpose of funding
|
0023| municipal fire member coverage plans. The state treasurer shall
|
0024| transfer the appropriation to the employers accumulation fund on
|
0025| or before July 31, 1996. The amount of the appropriation shall
|
0001| be matched by employers or employees, or both, of participants
|
0002| in the municipal fire member plans by a contribution of an
|
0003| amount equal to one percent of the employer's monthly payroll
|
0004| for fiscal year 1997.
|
0005| B. Any unexpended or unencumbered balance remaining
|
0006| at the end of fiscal year 1997 shall not revert to the fire
|
0007| protection fund.

0018| RELATING TO PUBLIC RETIREMENT; PROVIDING FOR VOLUNTEER AND

0019| MUNICIPAL FIREFIGHTERS RETIREMENT; AMENDING A SECTION OF THE

0020| NMSA 1978; MAKING AN APPROPRIATION.

0022| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0023| Section 1. Section 10-11A-3 NMSA 1978 (being Laws 1983,
|
0024| Chapter 263, Section 3) is amended to read:
|
0025| "10-11A-3. VOLUNTEER FIREFIGHTERS RETIREMENT FUND--CREATION--TRANSFER OF FUNDS FROM THE [FIRE PROTECTION]
|
0001| GENERAL FUND.--
|
0002| A. There is created the "volunteer firefighters
|
0003| retirement fund" in the state treasury. All annuities and
|
0004| benefits in lieu of annuities shall be paid from the fund as
|
0005| provided in the Volunteer Firefighters Retirement Act.
|
0006| B. Beginning in [the seventy-third] fiscal year
|
0007| 1997, the state treasurer shall transfer annually on or before
|
0008| the last day of July [five hundred thousand dollars
|
0009| ($500,000)] seven hundred fifty thousand dollars ($750,000)
|
0010| from the [fire protection] general fund to the credit of the
|
0011| volunteer firefighters retirement fund."
|
0012| Section 2. APPROPRIATION.--
|
0013| A. Three hundred thousand dollars ($300,000) is
|
0014| appropriated from the general fund to the employers accumulation
|
0015| fund in the Public Employees Retirement Act for expenditure in
|
0016| fiscal year 1997 for the purpose of funding municipal fire
|
0017| member coverage plans. The state treasurer shall transfer the
|
0018| appropriation to the employers accumulation fund on or before
|
0019| July 31, 1996. The amount of the appropriation shall be matched
|
0020| by employers or employees, or both, of participants in the
|
0021| municipal fire member plans by a contribution of an amount equal
|
0022| to one percent of the municipal fire member plan's monthly
|
0023| payroll for fiscal year 1997.
