0012| RELATING TO EDUCATION; AUTHORIZING AN INCREASE IN THE NUMBER OF

0013| SCHOLARSHIPS FOR NEW MEXICO RESIDENTS ENROLLED IN CERTAIN STATE
|
0014| EDUCATIONAL INSTITUTIONS; AUTHORIZING THE ESTABLISHMENT AND
|
0015| GRANTING OF SCHOLARSHIPS AT CERTAIN TWO-YEAR PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS; MAKING AN APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 21-1-2 NMSA 1978 (being Laws 1970,
|
0019| Chapter 9, Section 1, as amended by Laws 1989, Chapter 44,
|
0020| Section 3 and by Laws 1989, Chapter 45, Section 3 and also by
|
0021| Laws 1989, Chapter 68, Section 1) is amended to read:
|
0022| "21-1-2. MATRICULATION, [AND] TUITION AND REQUIRED
|
0023| FEES.--
|
0024| A. Except as otherwise provided in this section, the
|
0025| boards of regents of the university of New Mexico, New Mexico
|
0001| state university, New Mexico highlands university, western New
|
0002| Mexico university, eastern New Mexico university, New Mexico
|
0003| military institute and New Mexico institute of mining and
|
0004| technology and the governing board of New Mexico junior
|
0005| college shall establish and charge matriculation fees, [and]
|
0006| tuition and other required fees as follows:
|
0007| (1) each student shall be charged a
|
0008| matriculation fee of not less than five dollars ($5.00) upon
|
0009| enrolling in each institution;
|
0010| (2) each student who is a resident of New
|
0011| Mexico shall be charged [a] tuition [fee] and required
|
0012| fees of not less than twenty dollars ($20.00) a year;
|
0013| (3) each student who is not a resident of New
|
0014| Mexico shall be charged [a] tuition [fee] and required
|
0015| fees of not less than fifty dollars ($50.00) a year;
|
0016| (4) each student shall be charged [a] tuition
|
0017| [fee] and required fees of not less than ten dollars
|
0018| ($10.00) for each summer session; and
|
0019| (5) each student may be charged [a] tuition
|
0020| [fee] and required fees for extension courses.
|
0021| B. Except as otherwise provided in this section, the
|
0022| board of regents of northern New Mexico state school shall
|
0023| establish and charge each student a matriculation fee, [and a]
|
0024| tuition [fee] and required fees.
|
0025| C. The board of regents or governing board of each
|
0001| institution may establish and grant [gratis] scholarships to
|
0002| students who are residents of New Mexico [by waiving] in an
|
0003| amount not to exceed the matriculation fee or tuition and
|
0004| required fees or both. Scholarships awarded by the board of
|
0005| regents or governing board shall be called legislative
|
0006| scholarships. The number of legislative scholarships
|
0007| established and granted shall not exceed [three] five
|
0008| percent of the preceding fall semester enrollment in each insti-
|
0009| tution and shall not be established and granted for summer
|
0010| sessions. [The president of each institution shall select and
|
0011| recommend to the board of regents of his institution, as
|
0012| recipients of scholarships, students who possess good moral
|
0013| character and satisfactory initiative, scholastic standing and
|
0014| personality.] Legislative scholarship recipients shall have
|
0015| demonstrated successful academic performance and maintain
|
0016| satisfactory scholastic standing. At least thirty-three and
|
0017| one-third percent of the [gratis] scholarships established and
|
0018| granted by each board of regents or governing board each year
|
0019| shall be granted on the basis of financial need.
|
0020| D. The commission on higher education may adopt
|
0021| guidelines to assist institutions in the administration of the
|
0022| legislative scholarships program.
|
0023| [D.] E. The board of regents or governing
|
0024| board of each institution set out in this subsection may
|
0025| establish and grant, in addition to [those] legislative
|
0001| scholarships provided for in Subsection C of this section,
|
0002| athletic scholarships, [by waiving] tuition and required
|
0003| fees. In no event shall the board of regents or governing
|
0004| board of any institution be allowed to [waive the] award
|
0005| scholarships for tuition and required fees for more than the
|
0006| number of athletic scholarships set out in this subsection and
|
0007| in no event shall more than seventy-five percent of the
|
0008| [waivers granted] scholarships awarded be for out-of-state
|
0009| residents:
|
0010| (1) the board of regents of the university of
|
0011| New Mexico may grant up to the equivalent of two hundred
|
0012| ninety-three athletic scholarships for tuition and required
|
0013| fees;
|
0014| (2) the board of regents of New Mexico state
|
0015| university may grant up to the equivalent of two hundred
|
0016| seventy athletic scholarships for tuition and required fees;
|
0017| (3) the boards of regents of New Mexico
|
0018| highlands university, eastern New Mexico university and western
|
0019| New Mexico university may each grant up to the equivalent of
|
0020| one hundred forty athletic scholarships for tuition and
|
0021| required fees; and
|
0022| (4) the governing board of New Mexico junior
|
0023| college [board] may grant up to the equivalent of fifty-two
|
0024| athletic scholarships for tuition and required fees.
|
0025| [E.] F. Notwithstanding the provisions of
|
0001| Subsection [D] E of this section, in computing tuition
|
0002| credits the commission on higher education shall accept the
|
0003| value of [waivers of] scholarships for tuition and
|
0004| required fees established by the boards of regents of the
|
0005| university of New Mexico, New Mexico state university, eastern
|
0006| New Mexico university, western New Mexico university and New
|
0007| Mexico highlands university for athletes for the seventy-eighth
|
0008| fiscal year and all fiscal years thereafter. In no event shall
|
0009| the board of regents of any such institution be allowed to
|
0010| [waive the] establish scholarships for tuition and
|
0011| required fees for more than the number of athletic schol-
|
0012| arships permitted that institution by regulations and bylaws of
|
0013| the national collegiate athletic association or the national
|
0014| association of intercollegiate athletics of which that insti-
|
0015| tution is a member.
|
0016| [F.] G. Matriculation fees, [and] tuition and
|
0017| required fees shall be fixed and made payable as directed by
|
0018| the board of regents or governing board of each institution,
|
0019| collected by the officers of each institution and accounted for
|
0020| as are other funds of the institutions. Matriculation fees
|
0021| shall be charged only once for each institution in which a
|
0022| student enrolls."
|
0023| Section 2. Section 21-13-10 NMSA 1978 (being Laws 1963,
|
0024| Chapter 17, Section 9, as amended) is amended to read:
|
0025| "21-13-10. BOARD DUTIES.--
|
0001| A. It shall be the duty of the community college
|
0002| board to determine financial and educational policies of the
|
0003| community college. The community college board shall provide for
|
0004| the management of the community college and execution of these
|
0005| policies by selecting a competent president for the community
|
0006| college, and, upon the president's recommendation, the board
|
0007| shall employ other administrative personnel, instructional staff
|
0008| or other personnel as may be needed for the operation,
|
0009| maintenance and administration of the community college.
|
0010| B. The community college board shall have the power
|
0011| to fix tuition and fee rates for resident and nonresident
|
0012| students of the district, to accept gifts, to accept federal
|
0013| aid, to purchase, hold, sell and rent property and equipment and
|
0014| to promote the general welfare of the institution for the best
|
0015| interest of educational service to the people of the community
|
0016| college district.
|
0017| C. The community college board may establish and
|
0018| grant legislative scholarships to students who are residents of
|
0019| New Mexico by granting the matriculation fee or tuition and
|
0020| required fees, or both. The number of legislative scholarships
|
0021| established and granted shall not exceed five percent of the
|
0022| preceding fall semester enrollment in each institution and shall
|
0023| not be established and granted for summer sessions. Legislative
|
0024| scholarship recipients shall have demonstrated successful
|
0025| academic performance and maintain satisfactory scholastic
|
0001| standing. At least thirty-three and one-third percent of the
|
0002| scholarships established and granted by each community college
|
0003| board each year shall be granted on the basis of financial
|
0004| need."
|
0005| Section 3. A new Section 21-16-6.1 NMSA 1978 is enacted to
|
0006| read:
|
0007| "21-16-6.1. [NEW MATERIAL] MATRICULATION AND TUITION
|
0008| FEES.--The board may establish and grant legislative
|
0009| scholarships to students who are residents of New Mexico by
|
0010| granting the matriculation fee or tuition and required fees, or
|
0011| both. The number of legislative scholarships established and
|
0012| granted shall not exceed five percent of the preceding fall
|
0013| semester enrollment in each institution and shall not be
|
0014| established and granted for summer sessions. Legislative
|
0015| scholarship recipients shall have demonstrated successful
|
0016| academic performance and maintain satisfactory scholastic
|
0017| standing. At least thirty-three and one-third percent of the
|

|

0020| Section 4. A new Section 21-17-4.2 NMSA 1978 is enacted to
|
0021| read:
|
0022| "21-17-4.2. [NEW MATERIAL] MATRICULATION AND TUITION
|
0023| FEES.--The board may establish and grant legislative
|
0024| scholarships to students who are residents of New Mexico by
|
0025| granting the matriculation fee or tuition and required fees, or
|
0001| both. The number of legislative scholarships established and
|
0002| granted shall not exceed five percent of the preceding fall
|
0003| semester enrollment in each institution and shall not be
|
0004| established and granted for summer sessions. Legislative
|
0005| scholarships recipients shall have demonstrated successful
|
0006| academic performance and maintain satisfactory scholastic
|
0007| standing. At least thirty-three and one-third percent of the
|
0008| scholarships established and granted by each board each year
|
0009| shall be granted on the basis of financial need."
|
0010| Section 5. APPROPRIATION.--Two million one hundred sixteen
|
0011| thousand dollars ($2,116,000) is appropriated from the general
|
0012| fund to the commission on higher education for expenditure in
|
0013| fiscal year 1997 for the purpose of funding legislative
|
0014| scholarships for New Mexico residents enrolled in certain public
|
0015| post-secondary educational institutions. The commission on
|
0016| higher education shall distribute this appropriation to
|
0017| appropriate educational institutions on the same basis as
|
0018| existing funds provided for that purpose. Any unexpended or
|
0019| unencumbered balance remaining at the end of fiscal year 1997
|
0020| shall revert to the general fund.
|
0021| Section 6. EFFECTIVE DATE.--The effective date of the
|
0022| provisions of this act is July 1, 1996.
