0012| RELATING TO PUBLIC EMPLOYMENT; AMENDING A CERTAIN SECTION OF THE

0013| NMSA 1978 PERTAINING TO GROUP INSURANCE CONTRIBUTIONS OF PUBLIC

0014| EMPLOYERS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 10-7-4 NMSA 1978 (being Laws 1941,
|
0018| Chapter 188, Section 1, as amended) is amended to read:
|
0019| "10-7-4. GROUP INSURANCE--CAFETERIA PLAN--CONTRIBUTIONS
|
0020| FROM PUBLIC FUNDS.--
|
0021| A. All state departments and institutions and all
|
0022| political subdivisions of the state, excluding municipalities
|
0023| and counties, shall cooperate in providing group term life,
|
0024| medical or disability income insurance for the benefit of
|
0025| eligible employees or salaried officers of the respective
|
0001| departments, institutions and subdivisions.
|
0002| B. Except as provided in Subsection C of this
|
0003| section, the group insurance contributions of the state or any
|
0004| of its departments or institutions, including institutions of
|
0005| higher education and the public schools, shall be made as
|
0006| follows:
|
0007| (l) seventy-five percent of the cost of the
|
0008| insurance of an employee whose annual salary is less than
|
0009| fifteen thousand dollars ($15,000);
|
0010| (2) seventy percent of the cost of the
|
0011| insurance of an employee whose annual salary is fifteen thousand
|
0012| dollars ($15,000) or more but less than twenty thousand dollars
|
0013| ($20,000);
|
0014| (3) sixty-five percent of the cost of the
|
0015| insurance of an employee whose annual salary is twenty thousand
|
0016| dollars ($20,000) or more but less than twenty-five thousand
|
0017| dollars ($25,000); or
|
0018| (4) sixty percent of the cost of the insurance
|
0019| of an employee whose annual salary is twenty-five thousand
|
0020| dollars ($25,000) or more.
|
0021| [As used in this subsection, "cost of the insurance" means
|
0022| the premium required to be paid to provide coverages] C. Any group insurance contributions of the
|
0023| political subdivisions of the state, except the public schools
|
0024| or institutions of higher education, shall not exceed sixty
|
0025| percent of the cost of the insurance. School districts or
|
0001| institutions of higher education may contribute any amount up to
|
0002| one hundred percent of the cost of the insurance; provided that
|
0003| a school district or institution of higher education shall not
|
0004| contribute less than the amounts set forth in Subsection B of
|
0005| this section.
|
0006| D. As used in this section, "cost of the insurance"
|
0007| means the premium required to be paid to provide coverage.
|
0008| [C.] E. When a public employee elects to
|
0009| participate in a cafeteria plan as authorized by the Cafeteria
|
0010| Plan Act and enters into a salary reduction agreement with the
|
0011| governmental employer, the provision of Subsection B of this
|
0012| section with respect to the maximum contributions that can be
|
0013| made by the employer are not violated and will still apply. The
|
0014| employer percentage or dollar contributions as provided in
|
0015| Subsection B of this section shall be determined by the
|
0016| employee's gross salary prior to any salary reduction agreement.
|
0017| [D.] F. Any group medical insurance plan offered
|
0018| pursuant to this section shall include effective
|
0019| cost-containment measures to control the growth of health care
|
0020| costs. The responsible public body that administers a plan
|
0021| offered pursuant to this section shall report annually by
|
0022| September 1 to appropriate interim legislative committees on the
|
0023| effectiveness of the cost-containment measures required by this
|
0024| subsection."
