0012| RELATING TO CARNIVAL RIDE REGULATION; AMENDING INSPECTION

0013| REQUIREMENTS FOR CARNIVAL RIDES; AMENDING THE CARNIVAL RIDE
|
0014| INSURANCE ACT.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 57-25-3 NMSA 1978 (being Laws 1993,
|
0018| Chapter 284, Section 3, as amended) is amended to read:
|
0019| "57-25-3. LIABILITY INSURANCE REQUIRED--CERTIFICATE OF
|
0020| INSPECTION REQUIRED--CARNIVAL RIDE INSURANCE FUND CREATED.--
|
0021| A. No person shall operate a carnival ride without a
|
0022| policy of insurance in an amount not less than [five million
|
0023| dollars ($5,000,000)] one million dollars ($1,000,000)
|
0024| against liability for injury to persons arising out of the
|
0025| operation of the carnival ride.
|
0001| B. Either a copy of the policy furnished to the
|
0002| insured or a certificate stating that the insurance required by
|
0003| this section is in effect shall be filed with the department and
|
0004| a local government entity.
|
0005| C. The policy shall contain a schedule listing by
|
0006| name and serial number each carnival ride insured by the policy.
|
0007| In the event of additions or deletions of carnival rides during
|
0008| the policy terms, such changes shall be shown on a change
|
0009| endorsement, a copy of which shall be submitted to the
|
0010| department and the local government entity.
|
0011| D. In the event of policy cancellation by either the
|
0012| insured owner or operator or the insurance company, the insured
|
0013| shall furnish notice of the cancellation to the department and
|
0014| the local government entity not later than ten days prior to
|
0015| cancellation.
|
0016| E. No person, owner or operator of a carnival ride
|
0017| shall operate any carnival ride without obtaining a certificate
|
0018| of inspection for each ride by an inspector of the department or
|
0019| its designee and filing the certificate of inspection with the
|
0020| local government. [The certificate of inspection shall be
|
0021| required each time a carnival ride is reassembled and before any
|
0022| member of the public is permitted to board the ride.] The
|
0023| owner or operator shall annually have each carnival ride
|
0024| inspected and annually file the certificate of inspection. The
|
0025| certificate of inspection shall state that the carnival ride
|
0001| operator or owner has had the rides independently inspected by a
|
0002| licensed engineer within twelve months of the operation of the
|
0003| ride within the state and whether any deficiencies noted by the
|
0004| engineer have been corrected.
|
0005| F. The insured shall pay a fifty dollar ($50.00) per
|
0006| carnival ride per inspection filing fee with the department.
|
0007| G. The "carnival ride insurance fund" is created in
|
0008| the state treasury. The fund shall consist of all filing fees
|
0009| received by the department pursuant to the Carnival Ride
|
0010| Insurance Act. Money in the carnival ride insurance fund is
|
0011| appropriated to the department for the purpose of carrying out
|
0012| the provisions of the Carnival Ride Insurance Act. The fund
|
0013| shall not be expended for any purpose other than carrying out
|
0014| the provisions of the Carnival Ride Insurance Act."
